Regular Council Meeting <br />October 10, 2022 <br />Page 5 <br />further stated that staff had met with Mr. Bassano on several occasions and it appeared the plan <br />to incur the lift station as part of the trail was the most desirable plan for eliminating the three <br />mile gap in the existing trail. Mr. Vine said staff did not see any issues with this option, <br />permitting the City to maintain the ability to access the lift station by way of this road for <br />foreseeable future when the trail is completed. <br />Mr. Vine said staff was seeking approval to work on an agreement between the City and <br />the Greater Paris Development Foundation regarding the inclusion of this road to the trail. <br />It was consensus of the City Council to move forward with an agreement between the <br />City and the Foundation. <br />13. Convene into executive session pursuant to: <br />A. Section 551.071 of the Texas Government Code, Consultation with Attorney, to <br />receive legal advice from the City Attorney about (1) pending or contemplated <br />litigation and/or (2) on matters in which the duty of an attorney to her client under the <br />Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly <br />conflict with this chapter, to -wit: Carico v. City of Paris. <br />B. Section 551.074 of the Texas Government Code, to deliberate the appointment, <br />employment, evaluation, reassignment, duties, discipline, or dismissal of a public <br />officer or employee as follows: annual evaluation of the city manager. <br />C. Section 551.074 of the Texas Government Code, to deliberate the appointment, <br />employment, evaluation, reassignment, duties, discipline, or dismissal of a public <br />officer or employee as follows: annual evaluation of the city attorney. <br />Mayor Portugal convened City Council into executive session at 6:35 p.m. <br />14. Reconvene into open session and possibly take action on those matters discussed in <br />executive session. <br />Mayor Portugal reconvened City Council into open session at 8:00 p.m. With regard to <br />items A and C, Mayor Portugal said no action was required. Mayor Portugal asked for a Motion <br />on item B. A Motion to approve a 2% COLA for the city manager was made by Council <br />Member Pankaj and seconded by Council Member Knox. Motion carried, 5 ayes — 0 nays. <br />15. Consider and approve future events for City Council and/or City Staff pursuant to <br />Resolution No. 2004-081. <br />Council Member Pankaj said the evaluation committee had been working with the Judge <br />with the scheduling of his evaluation for the November 8a` City Council meeting. Council <br />Member Knox reminded everyone of the upcoming Chamber Banquet on October 25th. <br />
