to alleviate the requirement for ROW dedication at the NE corner of Lot 10. The current plan <br />calls for an Arterial Roadway Classification and the applicant, Mr. Whitaker, applied to amend <br />the portion of the proposed route moving it 40 ft. North onto his adjoining property. This will <br />have the effect of removing the dedication requirement for Lot 10. In order to achieve this request, <br />City Staff initiated a 2nd agenda item on property owned by Terry and Sandra Fitzgerald. This <br />would be necessary to maintain the route continuity for the future arterial street contained in the <br />plan. Their attorney contacted me to express their objection. <br />RECOMMENDATION <br />Assuming approval of the previous `delete all' agenda item, Staff recommends denial of both <br />applications with consideration that the requests have become a moot point. <br />At its meeting held on 11/7/22 the P&Z unanimously recommended denial of these changes. <br />Page 2 of 2 <br />
