A C K a v rE"A T C H <br /> <br />Expenses wil1 be billed on the basis of actual out-of- <br />pocket travel, subsistence, telephone, printing, and <br />other miscellanp.ous costs incurred in connection with <br />the services. The maximum amount billed shall not <br />exceed $38.900 without written authorization. The <br />ENGINEER will bill the CITY monthly based on actual <br />time and expense charges. <br /> <br />B. For supplemental services, actual salary times a multi- <br />plier of 2.75 plus expenses. Each item of Supplemental <br />Services shall be specifically authorized by the-ENGINEER" ~\,v\,,' ~{ <br />in writing. and a bil1ing limit established before work <br />is started. <br /> <br />C. It is mutually agreed and understood that the above <br />schedules do not include any allowance for local city <br />taxes, license fees, or special state fees or taxes <br />(excluding state income tax) which may apply to such <br />schedule of fees. Should local taxes or fees be ap- <br />plicable in any regard, it is understood that amount <br />of such fees or taxes will be added to the above <br />schedule of fees. <br /> <br />SECTION III - CITY'S RESPONSIBILITIES <br /> <br />The CITY will furnish, as required for the work, and not at the expense of <br />the ENGINEER, the following items: <br /> <br />A. Property descriptions when such information is required. <br /> <br />B. All maps, drawings, records, audits, annual reports, and <br />other data that are available in the files of the CITY <br />and which may be useful in the work involved under the <br />Contract. <br /> <br />C. Access to public or private property, as necessary, when <br />required in conduct of field investigations. <br /> <br />SECTION IV - OTHER MATTERS <br /> <br />It is mutually understood and agreed: <br /> <br />A. That the ENGINEER shall not be liable for delays resulting <br />from causes beyond the reasonable control of the ENGINEER. <br /> <br />B. That the ENGINEER has made no warranties, expressed or im- <br />plied, which are not expressly set forth in this Contract. <br /> <br />C. That under no circumstances will the ENGINlLK b0 liable <br />for indirect or consequential damages. <br /> <br />C-2 <br />
