that was issued regarding the lights has been extended through October 15, but Mr. Strahan hopes <br />to have the problem resolved before then. <br />Mr. Avery thanked Mr. Strahan for posting the NOTAM and asked if the runway lights could be <br />left on overnight. Mr. Strahan said yes, the lights could be left on. Mr. Bill K. Allan said he thought <br />if you turn the lights on manually, it would override the photocell system and the lights would be <br />on all night. Mr. Strahan said they don't know exactly what the problem is, so it's hard to know if <br />that will happen. Mr. Strahan went on to say that Jerry Richey had been turning the lights on <br />manually before he left each day, but then some nights they will leave it as -is and then go back out <br />later to check them, and the lights would still be on. Mr. Allan stated that he had not had any <br />problems with the lights. Ms. Maughon told Mr. Strahan to continue working on fixing the lights. <br />5. Receive a presentation on the FY21 /22 Airport Budget. <br />Finance Director, Gene Anderson presented the board with the FY2021-2022 budget, stating that <br />it had been several years since the City had been involved in the budget process for the Airport. <br />Mr. Anderson stated that the airport received a Grant last year which was COVID related, but did <br />not necessarily have to be spent on COVID related expenses. He was able to use normal operating <br />expenses to justify the $69,000 they have already sent, which will most likely go towards an airport <br />maintenance project of some kind. After further discussion of the budget, he asked the board <br />members if they had any questions. Mr. Bill Allan asked when the fuel prices would go down. Mr. <br />Anderson stated it is the City's plan to be the lowest price in northeast Texas, or really close to it, <br />which should take effect by the end of November. Mr. Ball asked how the new fuel prices will be <br />calculated. Mr. Anderson said that they would compare fuel prices in surrounding areas and then <br />take into consideration what they are paying for the fuel. It is not the City's goal to profit from <br />fuel sales, but to break even. The board thanked Mr. Anderson for his presentation. <br />Ms. Ellis left at 5:39 P.M. <br />6. Receive a presentation from the City Attorney on the Texas Open Meetings Act. <br />City Attorney, Stephanie Harris introduced herself to the board members. She began giving the <br />members a brief overview of the Texas Open Meetings Act, explaining the legal definitions of, <br />"meeting, deliberation, quorum, and walking quorum." Ms. Harris stated that a "walking quorum" <br />is easy to accidently become a part of, so to be extra careful with relaying information between <br />board members. This includes in-person conversations, emails, text messages, etc. Ms. Harris went <br />on to explain the Penalties associated with the Texas Open Meetings Act, should any one violate <br />any of the laws. Ms. Harris then asked if there were any questions. Mr. Avery stated the reason <br />this topic is being brought up at all, is because the board needs to know how to address a safety <br />issue. Ms. Harris stated that any safety concerns should be immediately directed to the Airport <br />Manager, Paul Strahan, or other city staff; not at a board meeting. Ms. Harris stated that a safety <br />concern does not require board deliberation, and unless on the Agenda, cannot be discussed at a <br />board meeting. She went on to state that if the concern needed immediate attention, board members <br />should not wait until the next board meeting to express their concerns. Mr. Avery asked Ms. Harris <br />what should be done if a safety concern is made aware to city staff, but nothing is done about it. <br />Ms. Harris responded by informing Mr. Avery he may also speak to the City Manager, or the City <br />Attorney if it is a legal matter. Mr. Avery stated the he felt as if he did not receive professional <br />courtesy from the City when he bought up the safety concern about the lights, since there was <br />never a notice posted about the lights not working. After further discussion about how to handle <br />these matters going forward, the board thanked Ms. Harris for her presentation. <br />
