2. The conditional grant of the requested variance permits utilization of the existing paved <br />surface, with conditions thus allowing the reasonable use of the property for the proposed new <br />commercial building on the property. <br />3. There are special or unique condition(s) of restricted area, shape, topography, or physical <br />features that exist on the subject parcel of land, which are unique to this parcel of land (in this <br />zoning district), and which cause unusual and practical difficulty or an unnecessary hardship <br />if required parking lot improvements consistent with the ordinance provisions were required. <br />4. The hardship sought to be avoided is not the result of (a) The applicant's own actions (self- <br />imposed or self-created). <br />5. The provisions of Off -Street Paving Surfacing and Maintenance Standards if applied, would <br />deprive the applicant of reasonable rights to use the property that are commonly enjoyed by <br />other properties in commercial areas required to comply with these same ordinance provisions. <br />Motion was made by David Hamilton, seconded by Carlton Cooper to approve both variances to <br />Section 30-102(3) of the Buffering Regulations to eliminate the required 6' landscaping buffer on <br />the North and South side of the property based on the following board conditions and findings. <br />Motion carried 5-0. <br />CONDITIONS: <br />1. Existing asphalt in area that would have become landscaping buffer now has to be treated as <br />all parking areas requiring it to be swept. <br />2. The above conditions be completed prior to issuance of the Certificate of Occupancy. <br />4. A green space containing grass, adjacent to the existing sidewalk, will be created and <br />maintained by the applicant. <br />BOARD RECOMMENDED FINDINGS <br />1. The request for variance is in harmony with the general purpose and intent of the Zoning <br />Ordinance and maintains the spirit and intent of the Off -Street Parking Requirements and <br />landscaping provisions which serve to promote a higher quality of appearance and safety for <br />all commercial re -development projects within the community. <br />2. The denial of the request to remove the landscaping provisions (greenspace) would prevent the <br />reasonable use of the property for the new commercial building on the property. Especially in <br />a manner that conforms to the landscaping ordinance, and still provides reasonable use of the <br />
