Item No. 13 <br />Memorandum <br />TO: Mayor, Mayor Pro Tem and City Council <br />Grayson Path, City Manager <br />FROM: Todd Mittge, City Engineer <br />SUBJECT: Consideration of and action on the Final Plat of the Avery Estates, Lot 1, Block <br />A, LCAD Property ID 13853, located at 106 12" St NE <br />DATE: March 27, 2023 <br />BACKGROUND <br />The applicant requests approval of a Final Plat for the Avery Estates in order to establish a plat for <br />development of a two family home. <br />RECOMMENDATION <br />Staff recommends approval of the Final Plat subject to the following conditions: <br />1. ROW widths shall be shown and the source cited (whether previously recorded ROW <br />or a field measurement with dimensions) on both E. Houston St and 12th St. NE. <br />(Chapter 9A, Section IV, (5)) <br />2. The lot directly to the north of the parcel being platted (PCH 32 Addition Block A, <br />Lot 1) has 5ft of ROW dedication shown on its plat. The ROW shall be updated to <br />show this. (Chapter 9A, Section IV, (5)) <br />3. A side yard has been designated along E. Houston St in order to reduce the setback <br />width to 15ft. The owner has indicated that he wishes frontage of the building to face <br />E. Houston. The plat shall be revised to remove the side yard designation. (Chapter <br />913, Section 9, 9-602, (5)) <br />4. After required dedication of ROW, the parcel does not meet the lot width <br />requirements. A variance shall be required to be approved before release of the final <br />plat for recording. (Chapter 9B, Section 9, 9-201) <br />
