Planning & Zoning Commission Meeting <br />February 06, 2023 <br />Page 2 <br />5. Consideration of and action on the Final Plat of the KoBeck Addition, Lot 1, Block <br />A, LCAD Property 401549, located at 3275 FM 195. <br />Todd Mittge states the engineering staff recommends approval with noted condition: <br />The called "storage shed" on the west property line shall be moved to prevent <br />infringement on the platted property. (Chapter 9B, Section 9, 9-601) <br />A Motion to approve this item with noted condition was made by Board Member Michael <br />Mosher and seconded by Board Member Austin Anthony. Motion carried, 6 ayes — 0 nays. <br />6. Consideration of and action on the Preliminary Plat of the Avery Estates CB32 Addition, Lot <br />1, Block A, LCAD Property 13853, located at 102 NE 12" Street. <br />Todd Mittge states the engineering staff recommends approval with the following noted <br />conditions: <br />1. ROW widths shall be shown and the source cited (whether previously recorded ROW or <br />a field measurement with dimensions) on both E. Houston St and 12th St. NE. (Chapter <br />9A, Section IV, (5)) <br />2. The lot directly to the north of the parcel being platted (PCH 32 Addition Block A, Lot 1) <br />has 5ft of ROW dedication shown on its plat. The ROW shall be updated to show this. <br />(Chapter 9A, Section IV, (5)) <br />3. A side yard has been designated along E. Houston St in order to reduce the setback <br />width to 15ft. The owner has indicated that he wishes frontage of the building to face E. <br />Houston. The plat shall be revised to remove the side yard designation. (Chapter 9B, <br />Section 9, 9-602, (5)) <br />A Motion to approve this item with noted condition was made by Board Member Sims <br />Norment and seconded by Board Member Michael Mosher. Motion carried, 6 ayes — 0 nays. <br />7. Consideration of and action on the Final Plat of the Avery Estates CB32 Addition, Lot 1, Block <br />A, LCAD Property 13853, located at 102 NE 12th Street. <br />Todd Mittge states the engineering staff recommends approval with the following noted <br />conditions: <br />1. After required dedication of ROW, the parcel does not meet the lot width requirements. <br />A variance shall be required to be approved before release of the final plat for <br />recording. (Chapter 9B, Section 9, 9-201) <br />2. Prior to releasing the final plat for recording a site plan for the proposed building shall <br />be submitted and reviewed. (Chapter 9A, Section VIII, J, 1) <br />3. There are multiple discrepancies between the bearings listed under the field notes and <br />the bearings listed on the drawn plat.
