Discuss and act on ORDINANCE NO. 2023-044: AN ORDINANCE OF THE CITY <br />COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING A NEGOTIATED <br />SETTLEMENT BETWEEN THE ATMOS CITIES STEERING COMMITTEE <br />("ACSC") AND ATMOS ENERGY CORP., MID-TEX DIVISION REGARDING THE <br />COMPANY'S 2023 RATE REVIEW MECHANISM FILING; DECLARING <br />EXISTING RATES TO BE UNREASONABLE; ADOPTING TARIFFS THAT <br />REFLECT RATE ADJUSTMENTS CONSISTENT WITH THE NEGOTIATED <br />SETTLEMENT; FINDING THE RATES TO BE SET BY THE ATTACHED <br />SETTLEMENT TARIFFS TO BE JUST AND REASONABLE AND IN THE PUBLIC <br />INTEREST; APPROVING AN ATTACHMENT ESTABLISHING A BENCHMARK <br />FOR PENSIONS AND RETIREE MEDICAL BENEFITS; REQUIRING THE <br />COMPANY TO REIMBURSE ACSC'S REASONABLE RATEMAKING EXPENSES; <br />DETERMINING <br />Finance Director Gene Anderson said the Atmos rate -filing request had been reviewed by <br />the City's consultant for the Atmos Cities Steering Committee, which Paris was a member. He <br />also said the rate increase and negotiation between Atmos and SCSC resulted in a 23.9 million <br />dollar reduction in requested revenues by Atmos with an effective date of the rate increase to <br />take effect October 1, 2023. Mr. Anderson said staff recommended approval of this item. <br />A Motion to approve this item was made by Mayor Pro -Tem Pankaj and seconded by <br />Council Member Pilgrim. Motion carried, 7 ayes — 0 nays. <br />14. Discuss and act on RESOLUTION NO. 2023-033: A RESOLUTION OF THE CITY <br />COUNCIL OF THE CITY OF PARIS, TEXAS APPROVING AND AUTHORIZING A <br />TAX ABATEMENT AGREEMENT WITH HUHTAMAKI, INC.; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING <br />AN EFFECTIVE DATE. <br />PEDC Executive Director Maureen Hammond reported that Huhtamaki had been in the <br />community for fifty-one years and in the past several months, they had been working on a <br />project that would expand the Paris facility with a projected $85,000,000.00 in capital investment <br />and the addition of up to 80 new jobs. Ms. Hammond explained PEDC had approved the tax <br />abatement agreement which was de-escalating and for a ten year period. She said the County had <br />approved the agreement earlier that day and was asking that the Council approve it. Plant <br />Manager Adam Rowton thanked the City Council for consideration of the tax abatement. <br />Council Member Savage said this project was a great win for the community and said the <br />PEDC had worked hard with Huhtamaki making this happen. Council Members Pankaj and <br />Pilgrim echoed comments made by Council Member Savage. <br />A Motion to approve this item was made by Mayor Pro -Tem Pankaj and seconded by <br />Council Member Savage. Motion carried, 7 ayes — 0 nays. <br />
