Board of Adjustment Meeting <br />October 3, 2023 <br />Page 2 <br />No one else spoke in favor or opposition of the request. <br />Public hearing was declared closed. <br />Staff member Paige Unger made note of one input submitted by phone. <br />Yvonne Bowers of 214 NE 28t' St, in favor. <br />Motion was made by Lydia Fitzgerald, seconded by Alix Putnam to approve the variances <br />to the City of Paris Area Regulations, Sections 9-501(1) and 9-301(1) to allow construction <br />of a duplex on a 60' deep lot and with a 15' front yard setback on E Price Street based on <br />the following conditions and findings. Motion carried 4 ayes- 0 nays. <br />Board Recommended Conditions <br />1. Beginning at the 25' build line on NE 28th Street, 128' of privacy fence must be installed along <br />the northern property line running east and west, with a maximum height of 7'. <br />2. Mature trees in right of way along E Price and NE 28' Street must be preserved. <br />3. Off-street parking must be located entirely on the property. <br />Board Recommended Findins <br />1. The request for variance is in harmony with the general purposes and intent of site <br />improvement regulations contained in the Zoning Ordinance 1710 Exhibit 9B and the <br />Subdivision Ordinance 1315 Exhibit 9A; and will protect the character of the immediate <br />vicinity of the area. <br />2. The approval of the variance for lot depth and front yard setback will allow the site plan to be <br />approved to permit a residence to be constructed given the narrow lot dimensions and the <br />corner lot configuration. <br />3. There are special and unique condition(s) of existing sub -standard lot width which are not <br />applicable to all other existing parcels of land in the 2F Zoning District, and which cause <br />unusual and practical difficulty or unnecessary hardship to the use of the property with site <br />improvements permitted by the ordinance with the provision sought here to be varied. <br />4. The hardship sought to be avoided is the result of (a) the applicant's own actions (self-imposed <br />or self-created), but rather it is not based upon existing site parcel dimensions to support new <br />construction. <br />5. The provision of the ordinance regulation that are sought to be varied, deprive the applicant of <br />reasonable rights to use the property that are commonly enjoyed by other older residential <br />properties in the 2F Residential Zoning District which are required to comply with these same <br />ordinance provisions. <br />6. The pre-existing home and driveway fronted E Price Street which establishes a precedent. <br />
