Discuss, conduct a public hearing and act on ORDINANCE NO. 2024-004: AN <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, <br />AS HERETOFORE AMENDED, SO AS TO REZONE CITY OF PARIS BLOCK 352 <br />PART OF LOT 7, LCAD #110221 AND GIBSON VALLEY ESTATES, BLOCK A, <br />LOT 1 LCAD #101305, LOCATED IN THE 4200 BLOCK OF SOUTHEAST LOOP <br />286, FROM AN AGRICULTURAL DISTRICT (A) TO A COMMERCIAL DISTRICT <br />(C); DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP <br />OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, <br />A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE <br />DATE. <br />Mr. McGee said this item was in conjunction with the two previous items. He also said <br />the request for the zoning change was from Agriculture to Commercial and Planning and Zoning <br />recommended approval, as did City Staff. <br />Mayor Hughes opened the public hearing and asked for anyone wishing to speak about <br />this item, to please come forward. Discuss, provide direction to City Staff, and act on RESOLUTION NO. 2024-009: A <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />INITIATING THE DISANNEXATION PROCESS FOR PROPERTY LOCATED AT <br />3197 FM 1497 (LCAD #103254) WITHIN THE CITY LIMITS OF THE CITY OF <br />PARIS AND SETTING PUBLIC HEARINGS REGARDING THE SAME; MAKING <br />OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />PROVIDING AN EFFECTIVE DATE. <br />City Attorney Stephanie Harris said the City received an application for disannexation for <br />property located on FM 1497, from the Pentecostal Church of Paris. She said the reasons stated <br />in the application did not fall within any valid reason for disannexation under the City's policy or <br />state law. She also said the annexation that occurred in 1999 moved on a fairly a straight line <br />until it got to the church's property then jagged around to take in the church property and parcel <br />directly to the north. She said staff could find no reason as to why the annexation line was drawn <br />as such. She also said disannexation of the property would not create any impermissible islands <br />or keyholes. Ms. Harris reported that the Church was not on city water or sewer and the City did <br />not receive ad valorem taxes on the property because the church was tax exempt. Ms. Harris <br />outlined one option as being to deny the request and the other option was to pass a resolution <br />authorizing the disannexation process.
