Board of Adjustment Meeting
June 4, 2024
Page 2
Board Recommended Condition
1. All other development, construction and building standards shall be met.
Findim
1. The request for variance is in harmony with the general purposes and intent of site
improvement regulations contained in the Zoning Ordinance 1710 Exhibit 9B and the
Subdivision Ordinance 1315 Exhibit 9A; and will protect the character of the immediate
vicinity of the area.
2. The approval of the variance for lot depth will allow the plat to be approved without a
condition for variance allowing a duplex to be constructed.
3. There are special and unique condition(s) of existing sub -standard lot depth which are not
applicable to all other existing parcels of land in the 2F Zoning District, and which cause
unusual and practical difficulty or unnecessary hardship to the use of the property with site
improvements permitted by the ordinance with the provision sought here to be varied. The
residential lot was previously created, consistent with the adjoining residential lots, but was
not officially platted.
4. The hardship sought to be avoided is not the result of (a) the applicant's own actions (self-
imposed or self-created), but rather it is based upon existing site parcel dimensions to support
new construction.
5. The provision of the ordinance regulation that are sought to be varied, deprive the applicant
of reasonable rights to use the property that are commonly enjoyed by other older residential
properties in the 2F Residential Zoning District which are required to comply with these same
ordinance provisions.
4. Public hearing to consider and take action on the petition of Richard Martin, on behalf of
Larry and Betty Jones, regarding variances to the City of Paris Sign Ordinance, on Lot 2,
City Block 57 being located at 328 NMain Street. Sections and variances as follows:
1) Variance to allow a billboard on a Commercial lot, Section 4.10.006(a)(1).
2) Variance to allow a billboard on a lot located inside Loop 286, Section
4.10.006(d)(1).
3) Variance to allow a billboard closer than 10' of an electrical line, Section
4.10.006(d)(4).
4) Variance to allow a billboard within 500' of another permanent sign, Section
4.10.006(d) (5).
5) Variance to allow a billboard to be placed where it does not meet the minimum
distance from the front and North side property lines, building or structure
equal to the overall height of the billboard, Section 4.10.006(d)(6).
6) Variance to allow a billboard to be closer than the minimum 1000' buffer of
property used for residential purposes, Section 4.10.006(d)(7).
7) Variance to allow a billboard to be closer than 15' to the right-of-way for an
existing street, Section 4.10.006(d)(8).
8) Variance to allow an electronic, digital billboard, Section 4.10.006(g).
9) Variance to allow a nonconforming structure to be altered, Section 4.10.006(h).
