STATUS OF ISSUE: <br />During the Planning and Zoning Commission meeting, the option of whether a moratorium was <br />needed to prevent anyone to apply for an application to rezone a property within the areas in <br />question was discussed. The City Attorney indicated that the moratorium requirements and <br />processes were disfavored for this type of rezoning request because it involve findings of <br />insufficient infrastructure for development that is difficult to provide. Therefore, it is not <br />recommended. Moreover, should the rezoning petition be approved, that will create and classify <br />some properties in certain areas of the district as nonconforming uses. <br />The issue before the City Council now is to determine whether to rezone the area in question to <br />prevent duplexes or multi -family development. Moreover, should the boundary to be rezoned be <br />the stretch of Church Street between Sherman and Long Street within the Historic District Overlay <br />No. 2 (HD -2), or should it cover the entire Historic District Overlay No. 2 (HD -2) area currently <br />zoned (2F) Two -Family Dwelling District, which allows duplexes by right? <br />One (1) new duplex has been built at 1032 Church as allowed outright in 2F zoning after <br />the Historic Preservation Commission approved the design standards, and the Planning & <br />Zoning Commission approved the preliminary and final plat for the site in October 2023. <br />In the recent past, Staff has been directed to not initiate zoning changes without the property <br />owner's involvement and approval or at the owner's request. Not every property owner in this area <br />has indicated they are in favor of a zoning change. If directed by the City Council as recommended <br />by Planning and Zoning Commission, Staff could host a public meeting with stakeholders to <br />determine the interest level and include this information and present back to the Planning and <br />Zoning Commission for a recommendation to the City Council. <br />One of the considerations is to determine the shape of the area to be rezoned, i.e. which streets are <br />included along with the size of the area, which could be better determined after speaking with <br />property owners in the potentially impacted area. <br />BUDGET: <br />There are no significant budgetary implications due to this rezoning proposal. <br />OPTIONS: <br />1. Rezone the area to SF -1 to prevent any immediate application for duplexes and organize a <br />workshop to focus on a more targeted and appropriate area and rezone to SF -2 District. <br />
