ORDINANCE NO. 2024-027 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS <br />AMENDING ZONING ORDINANCE NO.1710 OF THE CITY OF PARIS, TEXAS, <br />AS HERETOFORE AMENDED, SO AS TO REZONE PROPERTIES LOCATED <br />WITHIN HISTORIC OVERLAY DISTRICT NO. 2 (HD -2), OTHERWISE <br />KNOWN AS THE CHURCH STREET HISTORIC DISTRICT TO SINGLE- <br />FAMILY DWELLING DISTRICT NO. 1 (SF -1); DIRECTING CHANGES <br />ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING <br />A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A <br />PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, on September 1, 2004, the City Council of the City of Paris passed <br />Ordinance No. 2004-021 creating Historic Overlay District No. 2 (HD -2) for a portion of the <br />city generally bounded by E. Kaufman Street on the north, 34th Street S.E. on the east, a <br />distance north of Hearne Avenue on the south, and 1St St. S.W extending to a distance of 3rd <br />Street S.W. on the west; and <br />WHEREAS, HD -2 is often also referred to as the Church Street Historic District; and <br />WHEREAS, Ordinance No. 2004-021 specifically "preserv[ed] the respective existing <br />use and zoning designations of the property included" in the new historic overlay district; <br />and <br />WHEREAS, HD -2 contains properties zoned in various zoning classifications <br />including Central Area (CA), Two -Family Dwelling District (217), Multiple Family Dwelling <br />District No. 1 (MF -1), Planned Development (PD), Public Lands and Institutions (PLI), and <br />Commercial District (C); and <br />WHEREAS, at its regular meeting on June 24, 2024, City Council directed staff to <br />initiate a zoning petition to rezone all properties within HD -2 which are not already zoned <br />SF -1 to SF -1 to better preserve the character of HD -2; and <br />WHEREAS, on August 5, 2024, following notice and publication as required by law, <br />the Planning and Zoning Commission conducted a public hearing on the proposed <br />amendments to the City Zoning Ordinance and, following said hearing, made formal <br />recommendation to the City Council to approve the requested zoning; and, <br />WHEREAS, on August 25, 2024, following notice and publication as required by law, <br />the City Council of the City of Paris conducted a public hearing on the proposed amendments <br />to the City Zoning Ordinance, and having considered the recommendations of the Planning <br />and Zoning Commission and the testimony and evidence introduced at said public hearing, <br />found and determined that approving the aforesaid zoning change would be consistent with <br />the Comprehensive Future Land Use Plan of the City of Paris, consistent with the City Zoning <br />Ordinance, and would be in the best interests of the public health, safety, and welfare of the <br />citizens of the City of Paris by a vote of 6 ayes and 0 nays. <br />
