ORDINANCE NO. 2024- 028 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />TEXAS, ADOPTING A REVISED AND CONSOLIDATED WATER <br />CONSERVATION/DROUGHT CONTINGENCY PLAN IN <br />ACCORDANCE WITH THE REQUIREMENTS OF SECTIONS 11.1271 <br />AND 11.1272 OF THE TEXAS WATER CODE AND APPLICABLE RULES <br />OF THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY; <br />MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE <br />SUBJECT; REPEALING ALL PRIOR DROUGHT CONTINGENCY AND <br />WATER CONSERVATION PLANS IN CONFLICT HEREWITH; <br />MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE <br />SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY <br />CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND <br />PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, Section 11.1271 of the Texas Water Code and applicable rules of the Texas <br />Commission on Environmental Quality require the holder of an existing permit, certified filing, or <br />certificate of adjudication for the appropriation of surface water in the amount of 1,000 acre-feet <br />a year or more for municipal, industrial, and other uses to develop, submit, and implement a water <br />conservation plan, consistent with the appropriate approved regional water plan, that adopts <br />reasonable water conservation measures as defined by Subdivision (8)(B), Section 11.002, which <br />defines "conservation" as those practices, techniques, and technologies that will reduce the <br />consumption of water, reduce the loss or waste of water, improve the efficiency in the use of water, <br />or increase the recycling and reuse of water so that a water supply is made available for future or <br />alternative uses; <br />WHEREAS, the City of Paris, Texas recognizes that the amount of water available to the <br />City and its water utility customers is limited and subject to depletion during periods of extended <br />drought; and, <br />WHEREAS, Section 11.1272 of the Texas Water Code and applicable rules of the Texas <br />Commission on Environmental Quality require all public water supply systems in Texas to prepare <br />and maintain a drought contingency plan; and, <br />WHEREAS, the City of Paris' Water Conservation and Drought Contingency Plan was <br />last updated on April 8, 2019 by Ordinance No. 2019-015; and, <br />WHEREAS, maintaining a clean, reliable supply of potable water is essential to the health, <br />safety, and welfare of the citizens of the City of Paris; and, <br />WHEREAS, following public hearing and opportunity for public comment on the 2024 <br />Water Conservation/Drought Contingency Plan, this plan was brought forward for City Council <br />approval; and, <br />Page 1 of 20 <br />
