Board of Adjustment Meeting <br />July 2, 2024 <br />Page 2 <br />Motion was made by Larry Walker, seconded by Carlton Cooper to approve the variance <br />to the City of Paris Off -Street Parking and Loading Regulations, Section 10-103 based on <br />the following condition and findings. Motion carried 4 ayes — 0 nays. <br />Condition <br />1. If parking situations in the future vary from the predictions of this parking study, that another <br />parking study be performed, at the property owner's expense to analyze the situation, and <br />provide additional parking based on the outcome of that study. The city would notify the <br />property owner in writing of any future issues and request that additional study. <br />Findings <br />1. The request for variance is in harmony with the general purposes and intent of Section 10-102 <br />Computing Parking and Loading Requirements. Staff agrees with the findings of the subject <br />property's parking study. Approval of this variance will not adversely affect the character of <br />the immediate vicinity of the area. <br />2. If approved, the smaller parking lot will reduce the impervious surfaces of the property and <br />will benefit the city with less runoff and potential stormwater issues. <br />3. The hardship sought to be avoided is not the result of (a) the applicant's own actions (self- <br />imposed or self-created), but rather it is based upon realistic site uses, with 5 shifts of work <br />over a 24-hour period, while providing for more future employees as well. <br />4. Public hearing to consider and take action on the petition of Richard Martin, on behalf of <br />Larry and Betty Jones, regarding variances to the City of Paris Sign Ordinance, on Lot 2, <br />City Block 57 being located at 328 NMain Street. Sections and variances as follows; <br />1) Variance to allow a billboard on a Commercial lot, Section 4.10.006(a)(1). <br />2) Variance to allow a billboard on a lot located inside Loop 286, Section <br />4.10.006(d)(1). <br />3) Variance to allow a billboard closer than 10' of an electrical line, Section <br />4.10.006(d) (4). <br />4) variance to allow a billboard within 500' of another permanent sign, Section <br />4.10.006(d) (5). <br />S) Variance to allow a billboard to be placed where it does not meet the minimum <br />distance from the front and North side property lines, building or structure <br />equal to the overall height of the billboard, Section 4.10.006(d)(6). <br />6) Variance to allow a billboard to be closer than the minimum 1000' buffer of <br />property used for residential purposes, Section 4.10.006(d)(7). <br />7) Variance to allow a billboard to be closer than 1 S' to the right-of-way for an <br />existing street, Section 4.10.006(d) (8). <br />8) Variance to allow an electronic, digital billboard, Section 4.10.006(g). <br />9) Variance to allow a nonconforming structure to be altered, Section 4.10.006(h). <br />10) Variance to allow a billboard to be altered beyond maintenance, Section <br />4.10.010(a) (1). <br />Mr. Hamilton closed the public hearing due to the application being withdrawn.
