Harris, City Attorney <br />SUBJECT: Cleanup amendment of Code of Ordinances to reflect current practice regarding <br />number of Planning and Zoning Commission members <br />DATE: September 23, 2024 <br />BACKGROUND: Decades ago, at least as far back as 1970, the City Council created the Planning <br />and Zoning Commission ("commission") in accordance with Chapter 211 of the Texas Local <br />Government Code. Chapter 2, Division 2, Sec. 2.03.031 of the Code of Ordinances provided for <br />the creation of the commission and further provided that the commission would comprise nine (9) <br />members. Judging by the commission's minutes, sometime between 1999 and 2000 City Council <br />decided to reduce the number of commissioners to seven (7), presumably to bring the commission <br />in line with other boards and commissions of the city and to make it easier to fill vacancies; <br />however, the city failed to amend Sec. 2.03.031 accordingly. The commission has been composed <br />of seven members since that time. <br />STATUS OF ISSUE: Attached hereto is a cleanup ordinance to bring Chapter 2, Division 2 into <br />alignment with what has long been the city's practice. It amends Sec. 2.03.031 to provide for a <br />seven member commission and amends Sec. 2.03.038 to provide that a quorum for the commission <br />will be four (4) rather than (5) members to correspond with the seven total members. The <br />commission discussed the issue at its regular meeting on September 5, 2024, and the consensus <br />was that the commissioners preferred to leave the commission at seven members. <br />BUDGET: No impact. <br />RECOMMENDATION: Move to adopt an ordinance amending Chapter 2, Division 2 of the Code <br />of Ordinances to reduce the number of members of the commission from 9 to 7 and to reduce the <br />number of members needed for a quorum from 5 to 4. <br />
