Item No. 9 <br />Memorandum <br />TO: Mayor, Mayor Pro -Tem, & City Council <br />FROM: Robert G. Vine, Interim City Manager <br />SUBJECT: Sale of City Owned Property - 1045 N. Main <br />DATE: December 9, 2024 <br />BACKGROUND: Several months ago, Glenn and Matthew Mattison, contacted staff and <br />inquired about purchasing City owned property located at 1045 N. Main. The Mattisons advised <br />they had been maintaining this lot for years as it adjoins their commercial lot. Due to the size and <br />location of the lot, staff determined it was undevelopable, to someone else other than an adjacent <br />property owner. Texas Local Government Code Sec. 272.001 (b)(1) and (c) provides an exception <br />to notice and bidding requirements applicable to the sale of property by municipal governments <br />for sales to adjacent property owners when the land in question is not adequate for development <br />in its current state due to its shape or small size. <br />STATUS OF ISSUE: Staff received an appraisal on the lot of $26,000 from Pat Murphy and <br />Associates and on April 22, 2024, in Executive Session, the Council directed staff to offer this lot <br />to the Mattisons for the appraised price of $26,000, which was later accepted. According to the <br />statute, appraised value is presumptive of market value. <br />BUDGET: This item does not impact the current budget. <br />RECOMMENDATION: Staff recommends the sale of the City owned lot located at 1045 N. <br />Main to Glenn and Matthew Mattison for the price of $26,000.00 and allow the Interim City <br />Manager to sign appropriate paperwork. <br />
