RESOLUTION NO. <br />A RESOLUTION OF THE BY THE CITY COUNCIL OF THE CITY OF PARIS, <br />TEXAS AUTHORIZING THE SALE OF PROPERTY LOCATED AT 1045 N. <br />MAIN STREET TO ADJACENT PROPERTY OWNERS MATTHEW AND <br />GLENN MATTISON; AUTHORIZING THE INTERIM CITY MANAGER TO <br />EXECUTE ANY AND ALL DOCUMENTS NECESSARY TO EFFECTUATE <br />THE SALE; MAKING OTHER FINDINGS AND PROVISIONS AND <br />DECLARING AN EFFECTIVE DATE. <br />WHEREAS, the City of Paris owns a narrow and undeveloped 0.14 acre parcel of land <br />located at 1045 N. Main Street, City of Paris Block 94, Lot 14 (the Parcel), which Parcel is <br />directly adjacent to and abutting property located at 1037 N. Main owned by Matthew and <br />Glenn Mattison (Buyers), and upon which Buyers operate an existing business; and <br />WHEREAS, Buyers have approached the City about purchasing the Parcel for use in <br />an expansion of their existing business; and <br />WHEREAS, Texas Local Government Code Sec. 272.001 (b)(1) and (c) provides an <br />exception to notice and bidding requirements applicable to the sale of property by municipal <br />governments for sales to adjacent property owners when the land in question is not <br />adequate for development in its current state due to its shape or small size (see Exhibit A <br />attached hereto; and <br />WHEREAS, said Parcel has been vacant for many years and the City has no plans to <br />use the Parcel for any purpose; and <br />WHEREAS, the Parcel has been appraised by and independent appraiser to have a <br />market value of $26,000.00, which appraisal has determined that the highest and best use of <br />the Parcel is as a commercial property (see Exhibit B hereto); and <br />WHEREAS, according to the statute, the appraised value land is conclusive of the fair <br />market value of the property; and <br />WHEREAS, Buyers have agreed to a purchase price of $26,000.00, the appraised <br />value of the Parcel; and <br />WHEREAS, sale of the Parcel will put it back on the property tax rolls and relieve the <br />City of its duty to maintain it; and <br />WHEREAS, the City Council of the City of Paris believes that it is in the best interest <br />of the City and its citizens to convey the property located at 1045 N. Main Street to Buyers at <br />the agreed upon price and to authorize the City Manager to execute all documents necessary <br />to effectuate the sale; <br />
