Interlocal Agreement with Lamar County and City of Paris
Re: Shared Fuel Farm
Agreement Considerations:
1. Term of the agreement -the agreement shall be a 10 -year agreement with an option to auto -
renew for an additional two, 5 -year terms. (After 20 years, the agreement should be revisited
- age of fuel delivery system, tanks, etc.)
2. City shall provide an initial payment of $100,000 with three additional payments of
$100,000 (totaling $400,000). This payment is intended to cover the 50% cost share of the
construction of the fuel farm facility. This payment shall be made no later than October 31 s`
3. The City shall pay the amount of $10,000 to Lamar County to be used for maintenance
costs associated with the fuel farm facility and/or to be used for a replacement fund solely
associated with the fuel farm facility for the future. This payment shall be made no later
than October 31s'.
4. The City agrees to pay monthly for fuel used in city vehicles and equipment during the
previous month and shall pay this directly to Lamar County. (We need to be careful with
how we word this as one entity cannot "sell" to another. Since this is a joint operation, it is
easier for one organization to pay for the fuel up front and we "reimburse" them for that we
have used.)
5. The City shall have access to the software associated with the fuel farm facility and the fuel
delivery system, with specific regard to the amount of fuel used by city owned vehicles
and/or equipment. The City could manage the software and provide similar information to
Lamar County. The City agrees to pay 50% of any annual extended maintenance agreement
associated with the software.
6. This agreement provided the City unabated and full access to the fuel farm facility, with the
exception of routine maintenance and/or unforeseen emergency situations causing the
facility to be unavailable.
