Theproposed residential structure of 1,440 square feet in the Two -Family Dwelling -(H) <br />creates a hardship to meet the required minimum, street front setbacks of 25 SF each per <br />City of Paris Area Regulations, Section -501(1). <br />3. Invariably, the Zoning Ordinance 1710 Section 9-602. (5) makes provision for such <br />variance situation and request to meet the minimum required front and side yards setback <br />per the code. The request, if approved will be in harmony with the general purposes and <br />intent of area regulations for residential buildings and lot regulations in Two -Family <br />Dwelling -(2F) contained in and will protect the character of the immediate vicinity of the <br />area. <br />4. There are no special or unique condition(s) of restricted area, such as the utility easement <br />that exists on the subject parcel of land that causes unusual and practical difficulty or <br />unnecessary hardship in compliance with the provisions sought here to be varied,, other <br />than a comer lot that requires two front yard setbacks issue that cannot be met, <br />irrespectively. <br />5. The hardship sought to be avoided is not necessarily the result of (a) the applicant's own <br />actions (self-imposed or self-created) and may cause (b) economic or financial "hardship" <br />should the application be denied. <br />6. The provision of the ordinance regulation that is sought to be varied will deprive the <br />applicant of reasonable rights to use property that are commonly enjoyed by other <br />61 <br />properties such as comer lot variance on front yard setback in the Single- and Two -Family <br />Dwelling Zoning District which are required to comply with these same ordinance <br />provisions. <br />4. Public hearing to consider and take action on the petition ofInvest Fannin LLC, on beha�f <br />of JohnnMiles, regarding a 15' variance to the Build Line that fronts E 8th Street, on <br />Y <br />Lot 10, Block A, of the J C Miles Subdivision being located at Parcel 129243, <br />David Hamilton opened the public hearing. <br />Director of Planning and Zoning, Osei Amo-Mensah presented the case to the board and <br />gave City recommendation. <br />Andrew Mack, on behalf of Invest Fannin LLC, spoke in favor of the request and answered <br />Ms. Draven'squestion about the location of the electrical utilities. Mr. Mack clarified that <br />the electrical would run across the front of the properties on Sycamore. <br />Staff member, Paige Unger, made note of the one input received in opposition of the <br />request. <br />No one else spoke in favor or opposition of the request. <br />Public hearing was declared closed. <br />
