requirements of this section must be included in all subawards, contracts, and purchase orders <br />under Federal awards. <br />(b) For purposes of this section: <br />1. "Produced in the United States" means, for iron and steel products, that all manufacturing <br />processes, from the initial melting stage through the application of coatings, occurred in the <br />United States. <br />2. "Manufactured products" means items and construction materials composed in whole or in <br />part of non-ferrous metals such as aluminum; plastics and polymer -based products such as <br />polyvinyl chloride pipe; aggregates such as concrete; glass, including optical fiber; and <br />lumber. <br />(c) Federal agencies providing Federal financial assistance for infrastructure projects must implement <br />the Buy America preferences set forth in 2 CFR part 184. <br />§ 200.323 Procurement of recovered materials. <br />(a) A city that is a State agency or agency of a political subdivision of a State and its contractors must <br />comply with section 6002 of the Solid Waste Disposal Act, as amended by the Resource <br />Conservation and Recovery Act of 1976 as amended, 42 U.S.C. 6962. The requirements of Section <br />6002 include procuring only items designated in the guidelines of the Environmental Protection <br />Agency (EPA) at 40 CFR part 247 that contain the highest percentage of recovered materials <br />practicable, consistent with maintaining a satisfactory level of competition, where the purchase <br />price of the item exceeds $10,000 or the value of the quantity acquired during the preceding fiscal <br />year exceeded $10,000; procuring solid waste management services in a manner that maximizes <br />energy and resource recovery; and establishing an affirmative procurement program for <br />procurement of recovered materials identified in the EPA guidelines. <br />(b) The city should, to the greatest extent practicable and consistent with law, purchase, acquire, or use <br />products and services that can be reused, refurbished, or recycled; contain recycled content, are <br />biobased, or are energy and water efficient; and are sustainable. This may include purchasing <br />compostable items and other products and services that reduce the use of single -use plastic <br />products. <br />See Executive Order 14057, section 101, Policy. <br />§ 200.324 Contract cost and price. <br />(a) The Federal agency or pass-through entity may review the technical specifications of proposed <br />procurements under the Federal award if the Federal agency or pass-through entity believes the <br />review is needed to ensure that the item or service specified is the one being proposed for <br />acquisition. The city must submit the technical specifications of proposed procurements when <br />requested by the Federal agency or pass-through entity. This review should take place prior to the <br />time the specifications are incorporated into a solicitation document. When the city desires to <br />accomplish the review after a solicitation has been developed, the Federal agency or pass-through <br />entity may still review the specifications. In those cases, the review should be limited to the <br />technical aspects of the proposed purchase. <br />(b) When requested, the city must provide procurement documents (such as requests for proposals, <br />invitations for bids, or independent cost estimates) to the Federal agency or pass-through entity for <br />pre- procurement review. The Federal agency or pass-through entity may conduct a pre - <br />procurement review when: <br />1. The recipient's or subrecipient's procurement procedures or operation fails to comply with <br />the procurement standards in this part; <br />2. The procurement is expected to exceed the simplified acquisition threshold and is to be <br />awarded without competition, or only one bid is expected to be received in response to a <br />solicitation; <br />3. The procurement is expected to exceed the simplified acquisition threshold and specifies a <br />
