,ml,oard of Adjustment Meeting <br />January 6, 2026 <br />Page 3 <br />gave City recommendation. <br />No one else spoke in favor or Opposition of the request. <br />Public hearing was declared closed. <br />Motion was made by Ben Vaughan, seconded by Harley Draven to approve the variances <br />to the City of Paris Area Regulations, Sections 9-402.1(2) and 9-201(1 based on the <br />following findings. Motion carried 5 ayes - 0 nays. <br />FINDINGS: <br />1. The proposed lot is plated. <br />2. The request is for a reduced structure of 1200 SF in lieu of required 1500 SF and lot width <br />of 50 SF instead of 60 SF. The current land configuration is lot 2, Block 190 of the R4U <br />Addition. Mr. Michael White has re -plated his lots (1 &2) on Houston Street. There is a <br />ten-foot(10) plated Right -of -Way (ROW) dedication fronting Houston Street, and the lot <br />width indicates 50 SF. All other requirements are met. The applicant can meet the <br />mfor structure of 1500 SF if he chooses. He is requesting the structure variance of <br />f <br />0, 0, <br />300 SF because some other residential structures within the vicinity also do not meet the <br />minimum structure size of 1500 SF. The proposed home to be constructed on the lot will <br />be 1200 SF. The approved lot width is plated as 50 SF instead of the required minimum of <br />0 <br />60 F. The proposed house meets all the other zoning requirements. <br />3. Invariably, apart from the Zoning Ordinance 1710 Section 9-402.1 (2) and Section 9-201 <br />(1) that refers to structure size and lot width, the proposed lot meets the Minimum required <br />length, front, rear and side yards setback per the code. The request, if approved will be in <br />harmony with the general purposes and intent of area regulations for residential buildings <br />and lot regulations in Single -Family Dwelling -(SF' -2) District contained in and will -protect <br />the character of the "immediate vicinity of the area. <br />4. There are no special or unique condition(s) of restricted area, that exists on the subject <br />parcel of land that causes unusual and practical difficulty or unnecessary hardship in <br />compliance with the provisions sought here to be varied, other than the ten (10) foot ROW <br />dedication that was required on Houston Street and limited land to meet the minimum lot <br />width of 60 feet irrespectively. <br />5. The hardship sought to be avoided is not necessarily the result of (a) the applicant's own <br />actions (self-imposed or self-created) because of approved plated lot width of 50 feet and <br />other properties enjoy same structure size within the vicinity which may cause (b) <br />economic or financial "hardship" should the application be denied. <br />6. The provision of the ordinance regulation that is sought to be varied, will deprive the <br />applicant of reasonable rights to use property that are conunonly enjoyed by other <br />in the Single -Family Dwelling <br />properties such as structure size and lot width variances <br />(SF` -2) Zoning District which are required to comply with these same ordinance <br />provisions. <br />
