Amend Section 302.4 Weeds to read as follows: <br />302.4: Weeds. Premises and exterior property shall be maintained free from weeds or plant <br />growth ^w^^« ^{ that creates a condition detrimental to ublic health or safetp <br />includin L� but not limited to conditions that: <br />• Create a fire hazard; <br />• Harbor rodents, insects, or other vermin; <br />• Obstruct visibility for vehicular or pedestrian traffic; <br />• Impede drainage or create stagnant water conditions; or <br />• Otherwise pose a risk to the health, safety, or welfare of occupants or the public. <br />For sur ores of this section the cit ma rel u on the acrea a of anv lot as shown in the <br />official records of the appraisal district for the countv in which the ropertv is located. <br />Noxious weeds shall be prohibited. <br />Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs <br />provided; however, this term shall not include cultivated flowers and gardens. <br />Exception: On tracts of land Rreater than fivej5j acres includin an ri ht-of-wa easement <br />or draina a ditch uncultivated sass weeds or brush ma row to a height exceeding, <br />twelve 12 inches except within: <br />• One hundred 100 feet ad•ai cent to or„alon an dedicated ublic street or <br />• One hundred 100 feet from any propertyline adjacent to a lot containing, a <br />structure used for residential commercialor u� blit fur oses <br />Within these areas vegetation exceedin twelve 12 inches in hei ht shall be resumed to <br />create a condition detrimental to public health or safely. <br />Upon failure of the owner or agent having control of the property to abate such condition after <br />proper notice of violation has been served, the owner or responsible party shall be subject <br />to enforcement in accordance with Section 107.3 and applicable law. <br />If the condition is not corrected within the times ecified in the notice of violation the Citi <br />mai ,in accordance with state law: <br />• Enter the ro ert. <br />• Cut and remove the weeds or ve etation and <br />
