WHEREAS, on June 22, 2026, following notice and publication as required by law, the City Council of the City of Paris conducted a public hearing on the proposed amendments, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that the proposed changes to the City's Subdivision Ordinance, as set out below, are in the best interest of the public health, safety, and welfare of the citizens of the City of Paris by a vote of 5 ayes and 0 nays. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved and are incorporated herein for all purposes. Section 2. That Subdivision Ordinance No. 1315 shall be and is hereby amended by adding a new Subsection H to Section IX, "Design of Improvements," as follows, with the remaining subsections to be re -lettered accordingly: g4H. Stormwater Detention and Retention Facility Maintenance, Inspection, and Compliance Program. (1) Definitions. For purposes of this section, the following words and phrases shall have the meanings assigned to them below: (a) Detention Facilit . A stormwater management facility designed to temporarily store stormwater runoff and release it at a controlled rate. (b) Retention Facilit . A stormwater management facility designed to permanently retain water and provide stormwater quantity and/or quality control. (c) Facilit . Any stormwater detention facility, retention facility, water quality basin, drainage pond, stormwater control measure, or associated appurtenance required by this Chapter, approved engineering plans, development agreements, or the City of Paris Technical Standards Manual. (d) Operation and Maintenance Manual (O&M Manual). A document approved by the Engineering Department that establishes inspection, operation, maintenance, repair, and recordkeeping requirements for a stormwater facility. (e) Owner. Any person, corporation, partnership, homeowners association, property owners association, governmental entity, management company, or other legal entity having ownership or maintenance responsibility for a facility. (f) Responsible Party. The owner or other person designated by recorded instrument, maintenance agreement, plat note, restrictive covenant, or other legal document to maintain and operate a facility. (g) Program Manual. The City of Paris Stormwater Detention and Retention Facility Maintenance, Inspection, and Compliance Program Manual adopted pursuant to this Ordinance.
