For purposes of this subsection, all additions approved after the effective date of this <br />ordinance shall be aggregated in determining compliance with the thirty-five percent <br />(35%) limitation. <br />"C. Improvements Encouraging Conformity. <br />Improvements that reduce, eliminate, or lessen existing nonconformities shall be <br />encouraged and may be approved notwithstanding the limitations of subsection B when <br />the Building Official determines that the improvement results in greater compliance with <br />current zoning regulations. <br />"Examples include: <br />1. Relocation of structures to improve setback compliance; <br />2. Removal of encroachments; <br />3. Drainage improvements; <br />4. Accessibility improvements required by age or disability; <br />5. Reconstruction that reduces the degree of nonconformity. <br />"D. Limitations. <br />"Nothing in this section shall: <br />1. Authorize expansion of a nonconforming commercial, industrial, or multifamily <br />use; <br />2. Authorize creation of additional dwelling units; <br />3. Authorize any use prohibited within the zoning district; <br />4. Eliminate the requirement to obtain all necessary permits and approvals; <br />5. Establish a vested right to future expansions. <br />"E. Appeals. <br />"Any determination of the Building Official under this section may be appealed to the <br />Board of Adjustment in accordance with the provisions of this ordinance." <br />Section 3. That all provisions of the ordinances of the City of Paris, Texas in <br />conflict with the provisions of this ordinance are hereby repealed, and all other <br />provisions of the ordinances of the City of Paris not in conflict with the provisions of this <br />ordinance shall remain in full force and effect. <br />Section 4. That the repeal of any ordinance or part of ordinances affected by the <br />enactment of this ordinance shall not be construed as abandoning any action now <br />pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or <br />altering any penalty accruing or to accrue, or as affecting any rights of the municipality <br />under any section or provisions of any ordinance at the time of passage of this <br />ordinance. <br />
