heaQh, safety, and welfare of the citizens of the City of Paris by a vote of 5 ayes and <br />0 nays. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF PARIS, TEXAS: <br />Section 1. That the findings set out in the preamble to this ordinance are hereby <br />in all things approved and are incorporated herein for all purposes. <br />Section 2. That City of Paris Zoning Ordinance No. 1710, Section 15-100, <br />"Nonconforming Uses and Structures," shall be hereby amended by adding a new <br />Section 15-103, "Reinvestment in Legal Nonconforming Residential Uses," to read as <br />follows: <br />"15-103. Reinvestment in Legal Nonconforming Residential Uses <br />"Notwithstanding any provision of Sections 15-100 through 15-102, an existing owner - <br />occupied single-family dwelling that is a legal nonconforming use may be enlarged, <br />altered, reconstructed, modernized, or improved in accordance with this section. <br />"A. Eligibility. <br />"The Building Official may approve additions or alterations to a legal nonconforming <br />single-family dwelling when all of the following conditions are met: <br />1. The dwelling is a legal nonconforming residential use established pursuant to <br />Section 15-100; <br />2. The property is owner -occupied and qualifies for a homestead exemption through <br />the Lamar County Appraisal District, or owner occupancy is otherwise <br />demonstrated by sworn affidavit acceptable to the City; <br />3. The residential use remains a single-family dwelling and no additional dwelling <br />unit is created; <br />4. The proposed improvement does not increase residential density; <br />5. The proposed improvement complies with all applicable building, fire, drainage, <br />floodplain, and health regulations; <br />6. The proposed improvement does not increase any existing nonconformity <br />relating to setbacks, height, lot coverage, parking, screening, or other <br />dimensional standards; <br />7. The proposed improvement does not expand the use into a more intensive <br />residential or nonresidential use classification. <br />"B. Expansion Limitation. <br />The cumulative gross floor area of additions approved under this section shall not <br />exceed thirty-five percent (35%) of the gross floor area of the principal structure as <br />lawfully existing on the effective date of this ordinance. <br />
