<br />1. CONTRACT PERIOD <br />This agreement becomes effective upon final execution by the State and shall terminate on <br /> <br />August 31, 2000, or upon completion of the Project, whichever is first, unless terminated or <br /> <br />modified as hereinafter provided. <br /> <br />2. SCOPE OF PROJECT <br /> <br /> <br />The State and City agree that the scope of the project shall be limited to the scope <br /> <br />authorized by the Texas Transportation Commission and as shown on the attached "Exhibit A." <br /> <br /> <br />The work to be performed by the City will include all that is necessary to complete construction <br /> <br />of the Project. <br /> <br />3. ACQUISITION OF RIGHT-OF-WAY AND OTHER PROPERTY <br /> <br /> <br />A. The City shall perform all necessary requirements to acquire title in the name of <br /> <br /> <br />City to the desired right-of-way required for construction of the Project, which title <br /> <br /> <br />shall be acceptable to the State. The State will review the title to the desired right- <br /> <br /> <br />of-way and will either approve or reject the same, in writing, within twenty (20) <br /> <br /> <br />days of receipt of the same. If the State does not reject the same within said twenty <br /> <br /> <br />(20) day period, such title shall, for all necessary purposes, be deemed acceptable. <br /> <br />The City shall acquire all right-of-way free and clear of all improvements and/or <br /> <br /> <br />encroachments. The City shall comply with all requirements of Title II and Title <br /> <br /> <br />III of the Uniform Relocation Assistance and Real Property Acquisition Policies <br /> <br /> <br />Act of 1970, Title 42 U.S.C.A. Section 4601, et seq., including those provisions <br /> <br /> <br />relating to incidental expenses incurred by the property owners in conveying the <br /> <br /> <br />right-of-way to the City, and benefits applicable to the relocation of any displaced <br />3 <br />
