Johnson <br />Mayor Pro-Tern Tom House <br /> <br />Council Members <br />Roger Daugherty, Sr. <br />Mart House <br /> <br />PUBLISHED NOTICE OF ADOPTED ORDINANCE <br />ORDINANCE NO. 06-001 <br /> <br />An Ordinance of the City of Blossom, Lamar County, Texas, regulating <br />potentially dangerous dogs which constitute a high level of risk within the <br />City limits of Blossom. <br /> <br />WHEREAS, the City Council, in order to protect the public health, safety, and welfare of the citizens <br />of Blossom, deems it prudent and necessary to establish rules and regulations controlling dogs that <br />constitute a high level of risk; <br /> <br />NOW, THEREFORE, BE IT ORDAINED by the governing body of the City of Blossom, Lamar <br />County, Texas, that the following provisions be adopted, regulating dogs determined to constitute a <br />high level of risk: <br /> <br />Section I. Definition of dog with high risk <br /> <br />Breeds of dogs covered by this Ordinance which constitute a high level of risk and are <br />potentially dangerous with a past history of bite and/or attack are defined as follows: <br />- Chows, Pit Bulls, Rottweilers, Doberman Pinschers, wolf hybrids or any dog that is a mix of any <br />breed listed herein. <br /> <br />Section II. Adoption of Texas Health and Safety Code, Section 822 <br /> <br />Subchapters A, B, and D, Chapter 822/ Regulation of Animals, "Texas Health and Safety Code", <br />are hereby adopted by reference, as though fully occupied herein, as the rules and regulations <br />governing dangerous dogs that are a threat to animals and persons. Above referenced subchapters <br />of Chapter 822/ "Texas Health and Safety Code" are attached hereto as Exhibit A. <br /> <br />Section III. Administration <br /> <br />The City Administrator, or any other employee of the City of Blossom, so designated, is hereby <br />assigned the responsibility and authority to administer this Ordinance. Pursuant to Section 22.042/ <br />Local Government Code, the Mayor shall ensure that this Ordinance is properly carried out. <br /> <br />Except in circumstances wherein a dog is deemed to be an immediate threat or danger to any <br />person or animal, the City Administrator, or any other authorized designee, shall seek an <br />administrative remedy to correct alleged violations by methods indicated below: <br /> <br />A. After having received complaint(s) of alleged violations(s), an administrative notice shall be <br />forwarded to the alleged owner of the dog and/or the owner or resident of the property on <br /> <br />r"- <br />
