August29,2006
Page 2

Wendall Babb stated that the fence is close to the street and that the City
needs to do something about it today or last week.

Brenda Smith, 833 Hearon, said that the fence is hiding filth and she would
like to see something done about it. She has been fighting this situation for
years. Her mother has cancer and cannot rest at night with the barking dogs.

Cathy Gillean, 846 E. Washington, stated that Mr. Gore needs to comply with
the laws of the land.

Chester Martindale said that he passed by the location twice last month and
noticed that the fence is illegal. He could not see over the front fence. He
spoke with two of the neighbors and they said that the noise and odor is
terrible.

4. Consideration of and action on the petition of Don Gore to grant a variance of
Zoning Ordinance No. 1710, Section 9-502 (3), to modify the required front
fence setback from the front face of the house to a distance of 18' from the
front face of the house toward Hearon Street, on Lots 2 and 2A, Block B, of the
Nancy Wright Addition, being number 840 Hearon Street.

Motion was made by Chester Martindale, seconded by Rodney Bass, to deny
the variance request and for the ordinance to be enforced as it is written,
hence, remove the fence. Motion carried by a vote of 6 ayes and 0 nays.

5. The meeting adjourned at 12:10 p.m.

APPROVED THIS

DAY OF

,2006.

Chairman
