<br />Crime Control and Safe Streets Act of 1968, as amended. This provision states that a unit of a local <br />government must provide the same or better level of health insurance benefits to a public safety officer <br />who retires or is separated from service, as a direct or proximate result of a personal injury sustained in <br />the line of duty while responding to a hot pursuit or emergency situation, as the officer was receiving <br />while on active duty. <br /> <br />SECTION 14.191 Definitions <br /> <br />· Emergency situation is defined as, "any situation in which life or property is in danger." <br /> <br />· Firefighter is defined as, "an individual serving as an officially recognized or designated member <br />of a legally organized volunteer fire department of an officially recognized or designated public <br />employee member of a rescue squad or ambulance crew." <br /> <br />· Law enforcement officer is defined as, "an individual involved in crime and juvenile <br />delinquency control or deduction, or enforcement ofthe laws including, but not limited to police, <br />correction probation, parole and judicial officers." <br /> <br />· Public agency is defined as, "the United States, any State of the United States, the District of <br />Columbia, the Commonwealth of Puerto Rico, the Virgin Islands of the United States, Guam, <br />American Samoa, the Trust Territory of the Pacific Islands, the Commonwealth of the Northern <br />Mariana Islands, and any territory or possession of the United States, or any unit of local <br />government, department, agency, or instrumentality of any of the foregoing." <br /> <br />· Public safety officer is defined as, "an individual serving a public agency in an official capacity, <br />with or without compensation, as a law enforcement officer, firefighter, or rescue squad or <br />ambulance crew." <br /> <br />SECTION 14.192 - Covera2e <br /> <br />All injuries that are sustained by a law enforcement officer, firefighter, rescue squad or ambulance crew <br />member as a result of a "hot pursuit" or "emergency situation" that is deemed work related by Worker's <br />Compensation will be covered under the Public Safety Officers' Health Benefit Provision if the injury <br />results in the employee retiring or terminating employment. <br /> <br />41 <br /> <br />Revised 01-25-05 <br />
