Regular City Council Meeting
November 12,2007
Page 5

least three times and they had been approved by the City. Lisa Wright and Shawn Napier said
the plans met the minimum requirements. Council Member Wilson inquired about the fire
restriction between two buildings. Lisa said it was ten feet. In addition, Council Member
Wilson expressed concern about the one foot setback and said the adjoining property owner
would not be able to get a building permit without moving over ten feet from the building.
A.W. Clem asked if Council would be agreeable if they moved the building over two feet,
leaving a three feet setback. Council Member Wilson said he was not comfortable with that,
because it was too much building on the piece of property. Louis Yates, 1815 Majestic,
general contractor for the job and Brandon Chaney with Chaney Engineering both answered
questions from the Council regarding moving the building and changing the angle of the
parking spaces.

Mayor Freelen asked for anyone speaking against this item to do so. Sybil Colson, 819
Lamar Avenue; Betty Hampton, 238-28th N.E.; and Yvonne Bowers, 214-28th Street N.E.,
all spoke in opposition to the zoning change as presented. Ms. Hampton read a letter from
Edith Dunn, who also opposed the zoning change. With no one else speaking, Mayor Freelen
closed the public hearing.

In speaking with Mr. Chaney, Mr. Yates, and Mr. Clem, Lisa Wright informed Council
a possible solution was to move the building over five feet to the south, add an additional
parking space in the back, add two additional parking spaces in the front and eliminate the
driveway from Collegiate onto 28th Street. Mr. Clem agreed to modifY the plans as stated.
Council Member Wilson wanted to know how who was going to monitor this. Lisa Wright said staff
would not issue a building permit until receipt of a revised site plat.

Subject to the modifications, A Motion to approve this item was made by Council
Member Biard and seconded by Council Member Fisher.
