<br />Regular City Council Meeting <br />December 10, 2007 <br />Page 2 <br /> <br />4. Reconvene in open session to consider and take necessary action as deemed appropriate <br />regarding those matters discussed in the Executive Session. <br /> <br />Mayor Freelen convened Council into open session at 6:28 p.m. and Council subsequently <br />took a break. <br /> <br />Mayor Freelen reconvened Council into regular session at 6:42 p.m. and moved to item 3B <br /> <br />3.B. To receive Attorney advice on pending litigation, City of Paris v. City ofClarksville, <br />Cause No. 74469. <br /> <br />Council Member Biard made a Motion to authorize the City Attorney to follow Council's <br />instructions by proceeding with negotiations and Council Member Gray seconded the Motion. <br />Motion carried, 7 ayes - 0 nays. <br /> <br />A. To receive Attorney advice on Memorandum of Understanding pertaining to Lake Pat <br />Mayse water. <br /> <br />Mayor Freelen asked Kent McIlyar to explain this item. Kent explained that the City of Paris <br />had received inquiry and proposal from the City oflrving, Texas, about Irving's interest in possibly <br />discussing a purchasing agreement for raw water out of Lake Pat Mayse. He further explained that <br />the City of Irving was proposing that the City of Paris grant Irving a twelve month exclusive <br />negotiating time period. During that time the City of Paris and City of Irving would study the <br />feasibility of selling excess raw water out of Lake Pat Mayse. Kent stated that the City ofIrving was <br />willing to pay up to $160,000.00 in engineering and consulting fees to conduct the studies. He also <br />stated that Irving wanted to explore the possibility of Pat Mayse being a transfer point from the north. <br />Kevin Carruth added that the City ofIrving would pay an outright payment of$40,000.00 to the City <br />of Paris for the opportunity to discuss possibilities relating to purchase of water. <br /> <br />Council Member Strathern said he wanted additional time to study this item. Several Council <br />Members expressed a desire to have a public hearing and get input from citizens. It was a consensus <br />of the Council to schedule this item for a public hearing on December 17,2007. <br /> <br />Council Member Wilson made a Motion that no action be taken on this item and Council <br />Member Biard seconded it. Motion carried, 7 ayes - 0 nays. <br /> <br />5. Citizens Forum. <br /> <br />No one spoke. <br /> <br />-- 'T <br />
