A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING THE BIDS AND AWARDING THE CONTRACTS FOR FURNISHING THE LABOR, MATERIALS, AND EQUIPMENT, AND FOR PERFORMING ALL WORK REQUIRED FOR GROUNDS MAINTENANCE (MOWING) ON CITY OF PARIS PARKS AND FACILITIES TO THE LOWEST RESPONSIBLE BIDDERS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Paris did heretofore, advertise for bids for furnishing labor, materials, and equipment and for performing all work required for grounds maintenance (mowing) on City of Paris parks and facilities, which bids were received until 3:00 o'clock p.m., Tuesday, February 5, 2008; and, WHEREAS, the lowest responsible bid for gounds maintenance (mowing) at Eastgate Park, Chisum Memorial and 24" St. SE & Clarksville as shown on the attached bid tabulation was made by Powell Landscaping, 2709 E. Cherry St., Paris, Texas 75460, and the contract should be awarded to Powell Landscaping in accordance with the terms and conditions set out in the bid documents attached hereto as Exhibit A. WHEREAS, the lowest responsible bid for grounds maintenance at the remaining thirty- seven (37) locations as shown on the attached bid tabulation was made by K&B Lawn Care, 309 E. Main, Hugo, OK 74743, and the contract should be awarded to K&B Lawn Care in accordance with the terms and conditions set out in the bid documents attached hereto as Exhibit B. WHEREAS, if either of the low bidders referenced herein is unable to enter into a contract with the City of Paris or is unable to satisfy all terms and conditions set out in the Bid Documents attached hereto, then the alternate award should go to the next lowest responsible bidder, K&G Lawn Care & Landscaping, P. O. Box 110, Swink, OK 74761, for twenty-nine (29) locations as shown on the attached alternate bid tabulation in accordance with the terms and conditions set out in the bid documents attached hereto as Exhibit C. WHEREAS, if it is necessary to use the alternate award, the number of locations awarded to Powell Landscaping will increase to five (5) adding the Fire Field and 2200 Blk. College St. as shown on the attached alternate bid tabulation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That the bid of Powell Landscaping, for furnishing labor, materials, and equipment and for performing all work required for grounds maintenance (mowing) on City of Paris parks and facilities located at Eastgate Park, Chisum Memorial and 24`' St. SE & Clarksville, in the amounts shown on the attached bid documents, is hereby accepted as the lowest responsible bid which provides the best value to the City and the contract for these locations is hereby let
