RESOLUTION NO. 2008-099 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, CANVASSING THE RETURNS FOR THE NOVEMBER 4, 2008, CITY-WIDE SPECIAL ELECTION ON A PROPOSITION CALLING FOR THE ADOPTION OF AN ORDINANCE ESTABLISHING A LIMIT ON THE TOTAL AMOUNT OF TAXES THAT MAY BE IMPOSED ON THE RESIDENCE HOMESTEAD OF A DISABLED PERSON OR PERSON SIXTY-FIVE (65) YEARS OF AGE OR OLDER PURSUANT TO ARTICLE 8, SECTION 1-b(h) OF THE TEXAS COIVSTITUTION AND TEXAS TAX CODE SECTION 11.261; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on July 14, 2008 the City Council of the City of Paris approved Resolution 2008-051 ordering a city-wide special election to be held in the City of Paris on November 4, 2008 on the question of establishing a limit on the total amount of taxes that may be imposed on the residence homestead of a disabled person or person sixty-five (65) years of age or older pursuant to Article 8, Section 1-b(h) of the Texas Constitution and Section 11.261 of the Texas Tax Code; and, WHEREAS, in conformance with the Texas Election Code, said election was conducted on one of the uniform election dates set out in the Election Code, the next available uniform election date being Tuesday, November 4, 2008; and, WHEREAS, as required by City Charter and State Law, such election was conducted and held at the specified and designated polling places as set forth in Resolution No. 2008-051; and, WHEREAS, sealed returns of said election for all seven (7) Districts, made by the duly appointed and designated election officials of and for the respective voting boxes, having been made to the Mayor and City Council of the City of Paris, as required by law, which returns after due and deliberate review and canvass thereof, show the results as summarized herein; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved. Section 2. That a special election was held city-wide in all Council Districts of the City of Paris, Texas on Tuesday, November 4, 2008 for the purpose of submitting to the qualified voters of the City of Paris one proposition calling for the adoption of an ordinance establishing a limit on the total amount of taxes that may be imposed on the residence homestead of a disabled person or a person sixty-five (65) years of age or older pursuant to Article 8, Section 1-b(h) of the Texas Constitution and Texas Tax Code Section 11.261, in the form as follows:
