<br />PERFORMING AGENCY shall submit quarterly (or a different frequency specified in <br />writing by RECEIVING AGENCY) program progress reports (DH9Ia) covering the <br />PERFORMING AGENCY'S activities under this Attachment. <br /> <br />General Provisions, Patient or Client Records Article, is not applicable to this Attachment. <br /> <br />General Provisions, Confidentiality Article, is not applicable to this Attachment. <br /> <br />General Provisions, Termination Article, is amended to include the following: <br /> <br />Notwithstanding the foregoing provisions, at any time, PERFORMING AGENCY may, <br />in its sole discretion, detennine to discontinue fluoridation. If PERFORMING AGENCY <br />detennines to discontinue fluoridation, its sole obligation hereunder shall be to notify <br />RECENING AGENCY of its decision within thirty (30) days and make available to <br />RECENING AGENCY for pick-up by RECENING AGENCY all fluoridation <br />equipment financed hereunder. Thereafter, PERFORMING AGENCY shall have no <br />further obligations hereunder, including, no obligations to operate the fluoridation <br />equipment, perform onsite monitoring of fluoride level or submit water samples for <br />fluoride level analysis. <br /> <br />PERFORMING AGENCY and RECEIVING AGENCY, by signing this contract, do certify that: <br />1) this contract is authorized by the governing body of each party; and 2) each party paying for <br />the perfonnance of governmental functions or services is making those payments from current <br />revenues available to the paying party. <br /> <br />SECTION III. BUDGET: <br /> <br />RECENING AGENCY will reimburse PERFORMING AGENCY a lump sum amount upon <br />satisfactory completion of the installation as described in SECTION I. SCOPE OF WORK. <br /> <br />Total reimbursements will not exceed $ 25,800.00. <br /> <br />A TT ACHMENT - Page 4 <br />
