Section 3301.1.3, Fireworks, shall be amended to read as follows: <br />The possession, manufacture, storage, sale, handling and <br />use of fireworks are prohibited. <br />Exceptions: <br />1. Only when approved for fireworks displays, storage <br />and handling of fireworks as allowed in Section 3304 <br />and 3308. <br />2. The use of fireworks for approved display as allowed <br />in Section 3308. <br />The presence or use of fireworks within the jurisdiction <br />of the City of Paris in violation of this ordinance is hereby <br />declared to be a common and public nuisance. The restrictions <br />of this Section shall be applicable and in force throughout the <br />territory of the City of Paris, Texas. The owner, lessee or <br />occupant of the property or structure where fireworks are <br />being stored or used shall be deemed responsible for violating <br />this section. <br />Section 3301.7, Seizure, shall be amended by adding Section 3301.7.1, to <br />read as follows: <br />The Fire Code Official or his designee, or any peace officer <br />authorized to enforce the Ordinances of the Ciry of Paris, may <br />seize and destroy illegal fireworks prior to a court appearance <br />and a photograph of such seized and destroyed fireworks will <br />provide sufficient evidence of a violation of Section 3301.1.3 for <br />the municipal court. <br />Section 3302, Definitions, shall be amended, in part, by amending the <br />definition of "fireworks" to read as follows: <br />FIREWORKS. Any composition or device for the purpose of <br />producing a visible or an audible effect for entertainment <br />purposes by combustion, deflagration, detonation, and/or <br />activated by ignition with a match or other heat producing <br />device that meets the definition of 1.4G fireworks or 1.3G <br />fireworks as set forth herein. <br />32 <br />M UU1~~~811 <br />
