257 <br />258 <br />259 <br />260 <br />261 <br />262 <br />263 <br />264 <br />265 <br />266 <br />267 <br />268 <br />269 <br />270 <br />271 <br />272 <br />273 <br />274 <br />275 <br />276 <br />277 <br />278 <br />279 <br />280 <br />281 <br />282 <br />283 <br />284 <br />285 <br />286 <br />287 <br />288 <br />289 <br />290 <br />291 <br />292 <br />293 <br />294 <br />295 <br />296 <br />297 <br />298 <br />299 <br />300 <br />301 <br />facility or any other such waste having similar characteristics and effect, exclusive or the treated <br />effluent from a wastewater treatment plant. <br />Solid Waste: Any garbage, refuse, sludge from a waste treatment plant, water supply treatment <br />plant or air pollution control facility, and other discarded material, including solid, liquid, semi- <br />solid, or contained gaseous material resulting from industrial, municipal, commercial, mining, <br />and agricultural operations, and from community and institutional activities, but does not <br />include: <br />A. solid or dissolved material in domestic sewage, or solid or dissolved material in <br />irrigation retain flows, or industrial discharges subject to regulation by permit issued <br />pursuant to Chapter 26, Water Code. <br />B. soil, dirt, rock, sand and other natural man-made inert solid materials used to fill land <br />if the object of the fill is to make the land suitable for the construction of surface <br />improvements; or <br />C. waste materials that result from aetivities associated with the exploration, <br />development, or production or oil or gas and are subject to control by the Railroad <br />Commission of Texas. <br />Section 3- SCOPE OF SERVICES <br />A. The work under this Contract shall consist of the items contained in the proposal including <br />all the supervision, materials, equipment, labor and all other items necessary to complete said <br />work in accordance with the Contract. <br />B. In the event of a flood, tornado, severe inclement weather or similar or different act of God <br />over which the Contractor has no control, the City may suspend collection and the Contractor <br />and the City will negotiate the payment to be made to the Contractar. In addition, the City <br />agrees that such increase volume is to be handled by the Contractor. Further, if the City and <br />the Contractor reach such an agreement, then the City shall grant the Contractor variances in <br />routes and schedules as deemed necessary by the City Manager. <br />Section 4 - DISPOSAL SITE <br />The Contractor shall specify the name(s), location(s), and owner(s) (including the percentage of <br />ownership) of the disposal site(s) which the Contractor intends to use to perform the franchise. <br />The disposal site(s) shall be approved by the State of Texas, and written proof of the disposal <br />site's ability to handle all waste contemplated in this agreement shall be furnished to the City. <br />The Contractor shall also submit to the City proof that the disposal site(s) has/have complied <br />with annual licensing requirements, of the State of Texas for an annual fee and permit. Further, <br />the Contractor shall provide reasonable and satisfactory evidence to the City that the Contractor <br />will have the right to use the disposal site(s) under and for the duration of the franchise, <br />Specifications for Solid Waste Disposal Landfill Facility and Residential Solid Waste Collection Page 7 <br />.1 192 <br />
