DRAFT <br />S:\ORDWORK\CURRENT\Revenue Rescue - New Article IV, Chap 12 - Fire Service Fees ORD 2010FINAL.docx <br />ORDINANCE N0. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />ENACTING A NEW ARTICLE IV, FIRE AND RESCUE SERVICE FEES, TO <br />CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, <br />TEXAS; PROVIDING FOR THE COLLECTION OF FEES AND COSTS FOR <br />SERVICES RENDERED AT VEHICLE FIRES, VEHICLE ACCIDENTS, <br />HAZARDOUS WASTE SPILLS AND RESCUE INCIDEIVTS; MAKING OTHER <br />FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A <br />REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A <br />PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. <br />WHEREAS, the City of Paris Fire Department (the "Department") provides both <br />emergency and non-emergency response within the service area of the City of Paris, Texas; <br />and, <br />WHEREAS, the City of Paris Fire Department is equipped with and utilizes certain <br />apparatus, emergency tools, equipment, and materials as a means of saving lives and <br />property; and, <br />WHEREAS, the persons or entities requiring emergency services from the Department, <br />and for whom the referenced apparatus, tools, equipment, and materials have been utilized, <br />should reimburse the Department a portion of the costs associated with the use, loss, damage <br />and wear and tear to said tools, equipment, and materials incurred in connection with the act <br />of rendering emergency services to said persons or entities; and, <br />WHEREAS, the City Council has determined that it is in the best interest of the City of <br />Paris citizens to recoup the costs incurred by the Fire Department when providing emergency <br />and fire rescue services to persons involved in vehicle fires, accidents, hazardous waste spills, <br />etc. in the City of Paris, Texas; <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUIVCIL OF THE CITY OF <br />PARIS, TEXAS, THAT: <br />Section 1. The findings set out in the preamble to this ordinance are hereby in all <br />things approved. <br />Section Z. A new Article IV Fire and Rescue Service Fees to Chapter 12 of the Code <br />of Ordinances of the City of Paris, Texas is hereby enacted to read in its entirety as follows: <br />65 <br />
