DRAFT <br />S:\RESWORK\CURRENT\Special Election - Initiative Petition Ordering City-Wide Election RES 2011.docx <br />RESOLUTION N0. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, <br />ORDERING A CITY-WIDE SPECIAL ELECTION TO BE HELD IN THE CITY <br />OF PARIS ON THE SECOND SATURDAY IN MAY 2011, THE SAME BEING <br />THE 14TH DAY OF MAY, 2011, BETWEEN THE HOURS OF 7:00 0'CLOCK <br />A.M. AND 7:00 0'CLOCK P.M., TO CONSIDER A PROPOSITION CALLING <br />FOR THE ADOPTION OF AN ORDINANCE PROHIBITING PRIVATIZATION <br />OF THE COLLECTION, HANDLING, AND DISPOSITIOIV OF RESIDENTIAL <br />GARBAGE, TRASH, AND RUBBISH, AND PROVIDING A METHOD OF <br />FIXING CHARGES FOR SUCH SERVICE; PRESCRIBING THE FORM OF THE <br />BALLOT; PERMITTING ONLY RESIDENT QUALIFIED VOTERS TO VOTE; <br />PROVIDING FOR EARLY VOTING; PROVIDING FOR AN EARLY VOTING <br />BALLOT BOARD; PROVIDING FOR NOTICE OF THE ELECTION; MAKING <br />OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND <br />DECLARING AN EFFECTIVE DATE. <br />WHEREAS, an Initiative Petition was filed on January 5, 2011 with the City Clerk of <br />the City of Paris; and, <br />WHEREAS, the purpose of the aforesaid Petition was to call for the adoption by the <br />City Council of an Ordinance prohibiting privatization of collection and disposition of <br />residential garbage, trash and rubbish and providing for the method of fixing charges for <br />such service, and making other findings and provisions related to the subject of residential <br />garbage, trash, and rubbish collection, and providing for a penalty, and providing a <br />severability clause, and repealing all ordinances or parts of ordinances in conflict herewith <br />and providing for an effective date; and, <br />WHEREAS, under Charter requirement, the Petition was required to contain <br />signatures of 370 qualified voters to bring the ordinance before the City Council, however, <br />it only contained signatures of 320 qualified voters, thereby deeming the Petition <br />insufficient; and, <br />WHEREAS, because of aforesaid insufficiency a Certificate of Insufficiency was sent <br />to the Committee of Petitioners on January 24, 2011; and, <br />WHEREAS, a Supplemental Petition was filed on January 28, 2011 with the City <br />Clerk containing an additional 111 signatures; and, <br />WHEREAS, the City Clerk, in conformance with Sections 103 and 104 of the City <br />Charter, completed her review of the signatures appended to the Supplemental Petition <br />with regard to the validity of the aforesaid signatures, and their compliance with the <br />requirements of the City Charter and the Texas Election Code as to whether or not they <br />represented the signatures of qualified voters in a sufficient amount to qualify the Petition <br />appended thereto; and, <br />'U <br />
