WHEREAS, at the next regularly scheduled meeting of the City Council, the City <br />Clerk certified that a total of 431 signatures were received and validated by her and a <br />Certificate of Sufficiency was issued for the Initiative Petition; and, <br />WHEREAS, the City Council did by resolution dated February 14, 2011 accept and <br />acknowledge the City Clerk's certification that a sufficient number of valid signatures <br />appeared on the Petition to qualify the Petition as an Initiative Petition under the City <br />Charter; and, <br />WHEREAS, thereafter, in conformance with Section 106 of the City Charter, the City <br />Council did, at its February 14, 2011 regular meeting proceed at once to consider said <br />Petition, read the proposed Ordinance aloud, and conduct a public hearing upon the <br />proposed Ordinance, public notice of said hearing having been published at least twice in <br />the Paris News in advance of the aforesaid public hearing; and, <br />WHEREAS, following the reading of the proposed ordinance and a public hearing, <br />there was no support for the passage of said ordinance by a majority of the City Council, <br />therefore, the ordinance brought forward by Initiative Petition shall be submitted to the <br />voters of the City of Paris, Texas for their consideration at the next uniform election date; <br />and, <br />WHEREAS, in conformance with the Texas Election Code, said election must be <br />conducted at one of the uniform election dates set out in the Election Code, the next <br />available uniform election date being the second Saturday in May 2011, the same being <br />May 14, 2011; and, <br />WHEREAS, the City Council therefore desires to order a city-wide election to be <br />conducted on May 14, 2011 to let the voters cast their vote either in support or opposition <br />to the proposed ordinance; and, <br />WHEREAS, the election shall be administered by the Lamar County Elections <br />Administrator in accordance with the terms of the City's contract with Lamar County, <br />attached hereto as Exhibit A, the City Charter of the City of Paris, the Texas Election Code, <br />and Paragraphs 2, 3, 5, 6 and 7 of the District Court Order entered March 15, 1976, in Civil <br />Action No. P-75-3-CA, in the United District Court for the Eastern District of Texas, Paris <br />Division, and the laws of the State of Texas wherein they do not conflict with said Order. <br />WHEREAS, the Lamar County Election Administrator will use the Election Systems <br />& Software direct recording electronic voting systems for this election, which has been <br />certified by the Secretary of State in accordance with the Texas Election Code and approved <br />by the United States Department of Justice, and the City of Paris accepts this system. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />PARIS, TEXAS: <br />C~~ <br />
