(b) Notice of ihe time and place of the public auction and a descriptive list of the <br />motor vehicles or other property to be offered for sale shall be posted in city hall <br />for no less than 30 days. <br />(c) The purchaser of the motor vehicle or other property shall take title free and <br />clear of all liens and claims of ownership, shall receive a sales receipt from the <br />police department, and shall be entitled to register the purchased vehicle or other <br />property and receive a certificate of title, if applicable. <br />(d) The police deparhnent is entitled to reimbursement from the proceeds of the sale <br />of a motor vehicle or other property for the cost of the auction, towing, <br />preservation, storage, notice and publication fees. <br />(e) Any remainder from the proceeds of a sale shall be held for the owner or <br />lieriholder for 90 days. <br />(f) After the period provided by Subsection (e), proceeds unclaimed by the owner or <br />lienholder shall be deposited in an account that may be used for the payment of <br />auction, towing, preservation, storage, and notice and publication fees resulting <br />from impoundment, if the proceeds from the sale of the other items are <br />insufficient to meet those fees. <br />(g) All sales made pursuant to the provisions of this article shall be made for cash at <br />a public auction to the highest bidder for each piece of property; however, the <br />city reserves the right to reject all bids. <br />(h) The auction held pursuant to this article shall be conducted by the director of <br />finance. <br />Sec.25-223. Garagekeepers. <br />Where a Garagekeeper seeks to have the city sell a vehicle left in its possession, <br />the city and Garagekeeper shall comply with all applicable provisions of Chapter 683, <br />Texas Transportation Code, as amended. <br />Section 3. All ordinances or parts of ordinances in conflict with this ordinance <br />are hereby repealed to the extent they conflict with this ordinance. <br />Section 4. If any provision, section, subsection, sentence, clause, or phrase of this <br />Ordinance, or the application of same to any person or set of circumstances is for any <br />reason held to be unconstitutional, void or invalid, the validity of the remaining portions <br />of this Ordinance or their application to other persons or sets of circumstances shall not <br />be affected thereby, it being the intent of the City Council in adopting this ordinance that <br />no portion hereof or provision or regulation contained herein shall become inoperative or <br />C:tDocumenYS wid Settingsljellis`I,oc:il Seftings Temporary Inteinet Files:Content.0utlook~C5+tiU0N6VMPOUNDMEN'I' pRDiNANCE- Second Reading WACO.doc <br />_ . 277 <br />
