<br />DRAFT <br />SECTION 9 - NON-DISCIPLINARY SEPARATIONS <br /> <br />SECTION 9.01 - Resi ationN olunta <br /> <br />Termination <br /> <br />An employee may leave City service in good standing if performance is satisfactory and he/she <br />submits a notice of resignation in writing at least ten (10) working days prior to the effective date <br />of termination. The City Manager may waive any portion of the notice period. <br /> <br />Upon termination, employees must return any and all properties of the City prior to receiving their <br />last paycheck. <br /> <br />SECTION 9.02 - La off <br /> <br />An employee may be laid off at-will. Whenever possible, an employee laid off from one City <br />department will be transferred to a suitable position elsewhere. At least two weeks notice shall be <br />given an employee prior to layoff or he/she will be given two (2) weeks severance pay. <br /> <br />Layoffs will be carried out on the basis of demonstrated job performance and efficiency based on the <br />opinion of the Department Head, with the most proficient employees being retained the longest. <br />Seniority within City service may be used to determine the order of layoff among employees with <br />substantially equivalent records of job performance and efficiency with the most senior employees <br />being retained the longest. Temporary and probationary employees will be laid offbefore regular <br />employees performing similar duties. Layoffs will not be considered disciplinary actions. <br /> <br />Layoff of Civil Service employees will be governed by Civil Service Rule. <br /> <br />SECTION 9.03 - Unable to eñorm Essential Job Functions due to a Disablin Condition <br /> <br />An employee may be separated due to hislher inability to perform the essential functions of the <br />position due to a disabling condition. Medical information may be required to make this <br />determination. <br /> <br />SECTION 9.04 - Retirement <br /> <br />Retirement is defined as no longer being actively employed by the City and receiving a monthly <br />annuity from Texas Municipal Retirement System (TMRS) or Paris Firefighters Relief and <br />Retirement Fund(PFRRF). Eligible employees may leave employment in accordance with <br />applicable programs and laws. Employees who contribute to TMRS are eligible to retire with five <br />(5) years of service at age 60. Employees are also eligible to retire after twenty (20) years of service <br />at any age. Employees who contribute to the PFRRF are eligible to retire after 20 years at age 55 or <br />when years of service plus age equals 80. <br /> <br />22 <br /> <br />Rev. 10/27/04 <br />
