<br />DRAFT <br />SECTION 12 - PROCEDURES FOR GRIEVANCES AND APPEALS (EXCLUDES CIVIL <br />SERVICE EMPLOYEES) <br /> <br />~2.01 - Grievance Policy <br /> <br />It is the policy of the City to give employees an opportunity to discuss their grievances with their <br />supervisors in order to find mutually satisfactory solutions as rapidly as possible. In the presentation <br />of grievances at any level, employees are assured of freedom from restraint, interference, <br />discrimination or retaliation. Civil Service employees are not subject to this section and rely <br />exclusively on the remedy set forth in the Civil Service Law. <br /> <br />Any City employee who desires to file a grievance regarding a job related issue that specifically <br />affects hislher job status, payor employment has the right to file a grievance. Matters of general <br />policies even as applied to specific employees are not subject to the grievance procedure. The <br />grievance must be filed within five (5) workdays after the date of the incident or effective date of the <br />decision in which the employee is appealing. Civil Service employees will follow procedures set <br />forth in the Civil Service Law. <br /> <br />~ 12.02 - Representation <br /> <br />There is no third party representation in a grievance or an appeal. <br /> <br />SECTION 12.03 - Grievance Procedures <br /> <br />A. <br /> <br />ORAL REPORT: An employee who has a grievance will first present the grievance orally <br />to his or her Department Head or designee. <br /> <br />B. <br /> <br />WRITTEN REPORT: If the oral grievance presentation fails to settle the grievance, the <br />employee may within three (3) working days submit a written grievance form to hislher <br />Department Head. Such grievance must be filed within three (3) working days in order to <br />be considered. Within ten (10) working days after receiving such grievance, the Department <br />Head or designee will furnish the employee with a written reply to the grievance. <br /> <br />C. <br /> <br />APPEAL TO HUMAN RESOURCES OFFICER: If the written reply to the grievance is not <br />satisfactory to the employee, the employee may, within three (3) working days after receiving <br />the response, submit an appeal in writing to the Human Resources Director or his designee. <br />The Human Resources Director or his designee will confer with the aggrieved employee, the <br />employee's Department Head and any pertinent witnesses if applicable as determined by the <br />Human Resources Director or designee before making a recommendation to the City <br />Manager for a decision. <br /> <br />26 <br /> <br />Rev. 10/27/04 <br />
