<br />COUNTY OF LAMAR <br /> <br />§ <br />§ <br />§ <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />STATE OF TEXAS <br /> <br />SOLID WASTE AGREEMENT <br /> <br />This Solid Waste Agreement (this "Agreement") is entered into as ofthe - day <br />of June, 2005, between the City of Paris, Lamar County, Texas (herein "City") and Waste <br />Management of Texas, Inc. (herein "Contractor"), whereby Contractor agrees to operate <br />and maintain on behalf of the City and in lieu of City providing such service by its own <br />forces, the service of collection, hauling, and disposal of residential solid waste, garbage, <br />refuse, rubbish, and trash within the corporate boundaries of City, on such terms and <br />conditions and in return for such consideration as specified herein. <br /> <br />WITNE S SETH: <br /> <br />WHEREAS, the City as a Home Rule City is authorized under state law to <br />regulate and control solid waste collection and disposal within its city limits; and, <br /> <br />WHEREAS, Section 12 ofthe City Charter of the City authorizes the City <br />Council by ordinance to adopt and prescribe rules and regulations and fix charges and <br />compensation to be charged for the removal, handling, and disposition of all garbage, <br />trash, and rubbish within the city limits of the City; and, <br /> <br />WHEREAS, Section 16-21 (b) of the Code of Ordinances ofthe City designates <br />the City as the exclusive provider of residential garbage, rubbish, and waste collection <br />and disposal services for all Residential Units within the city limits of the City; and, <br /> <br />WHEREAS, the City Council has identified a short-fall in the general revenues <br />of the City and specifically a short-fall in the revenues generated for solid waste <br />collection; and, <br /> <br />WHEREAS, the City Council has elected to pursue a contract with private solid <br />waste disposal firms for collection and disposal of solid waste; and, <br /> <br />WHEREAS, the City Manager has sought proposals from various qualified waste <br />disposal firms related to various arrangements for the collection and disposal of solid <br />waste in the City; and, <br /> <br />WHEREAS, as a result of the process of competitive pricing and negotiation, the <br />City Manager has accepted a proposal from Contractor to contract for Residential Waste <br />disposal service within the City, whereby the City would continue to provide Customer <br /> <br />SOLID WASTE AGREEMENT <br /> <br />Page I <br />
