billing and account control and Contractor would provide Residential Waste collection and disposal services; and, WHEREAS, the Contract as proposed would cost the City $8.50 per month per residential Unit served, with an annual increase based on the Consumer Price Index, and as otherwise set forth herein; and, WHEREAS, Contractor has agreed to (i) purchase from the City trash hauling vehicles described on Schedule "1" attached hereto and incorporated herein for the sum of$159,000.00. and (ii) subject to the terms of this Agreement, use efforts to hire existing City solid waste employees; and, WHEREAS, the service provided would provide each Customer twice a week garbage service, with a maximum of ten (10) bags per pickup, plus one bulky pickup item per week; and, WHEREAS, in addition to the basic service, the Contractor would afford the City the opportunity to dispose of up to either (i) 150 tons, or (ii) 25 pulls of 30 cubic yard roll off containers, as selected by the City, of Abandoned Home Demolition Waste annually in Contractor's landfill without charge; and, WHEREAS, Contractor has also agreed to provide solid waste disposal services without charge to the City Hall, Police Station, Fire Stations, and as needed, at other City facilities, subject to the terms of this Agreement; and, WHEREAS, the City Council finds and determines that this Agreement is in the best interest of the City and advances the health, safety, and welfare of the citizens of the City. AGREEMENT I. DEFINITIONS The following definitions shall apply to this Agreement: 1.01 Ba~s: Plastic sacks, designed to store refuse with sufficient wall strength to maintain physical integrity when lifted by the top. Total weight of a bag and its contents shall not exceed thirty-five (35) pounds. 1.02 Brush: Plants or grass clippings, leaves or tree trimmings, and Christmas trees cut no longer than four (4) feet in length. 1.03 Bulkv Wastes: Stoves, refrigerators which have CFC's removed by a certified technician, water tanks, washing machines, furniture, loose brush greater than four (4) inches in diameter that cannot be bundled in four (4) foot lengths and weighs more than 50 lbs., and other similar waste materials other than construction debris, Dead Animals, Hazardous Waste, SOLID WASTE AGREEMENT Page 2
