<br />billing and account control and Contractor would provide Residential Waste collection <br />and disposal services; and, <br /> <br />WHEREAS, the Contract as proposed would cost the City $8.50 per month per <br />residential Unit served, with an annual increase based on the Consumer Price Index, and <br />as otherwise set forth herein; and, <br /> <br />WHEREAS, Contractor has agreed to (i) purchase from the City trash hauling <br />vehicles described on Schedule "1" attached hereto and incorporated herein for the sum <br />of$159,000.00. and (ii) subject to the terms of this Agreement, use efforts to hire <br />existing City solid waste employees; and, <br /> <br />WHEREAS, the service provided would provide each Customer twice a week <br />garbage service, with a maximum of ten (10) bags per pickup, plus one bulky pickup <br />item per week; and, <br /> <br />WHEREAS, in addition to the basic service, the Contractor would afford the City <br />the opportunity to dispose of up to either (i) 150 tons, or (ii) 25 pulls of 30 cubic yard roll <br />off containers, as selected by the City, of Abandoned Home Demolition Waste annually <br />in Contractor's landfill without charge; and, <br /> <br />WHEREAS, Contractor has also agreed to provide solid waste disposal services <br />without charge to the City Hall, Police Station, Fire Stations, and as needed, at other City <br />facilities, subject to the terms of this Agreement; and, <br /> <br />WHEREAS, the City Council finds and determines that this Agreement is in the <br />best interest of the City and advances the health, safety, and welfare of the citizens of the <br />City. <br /> <br />AGREEMENT <br /> <br />I. <br /> <br />DEFINITIONS The following definitions shall apply to this Agreement: <br /> <br />1.01 <br /> <br />Ba~s: Plastic sacks, designed to store refuse with sufficient wall strength <br />to maintain physical integrity when lifted by the top. Total weight of a <br />bag and its contents shall not exceed thirty-five (35) pounds. <br /> <br />1.02 <br /> <br />Brush: Plants or grass clippings, leaves or tree trimmings, and Christmas <br />trees cut no longer than four (4) feet in length. <br /> <br />1.03 <br /> <br />Bulkv Wastes: Stoves, refrigerators which have CFC's removed by a <br />certified technician, water tanks, washing machines, furniture, loose brush <br />greater than four (4) inches in diameter that cannot be bundled in four (4) <br />foot lengths and weighs more than 50 lbs., and other similar waste <br />materials other than construction debris, Dead Animals, Hazardous Waste, <br /> <br />SOLID WASTE AGREEMENT <br /> <br />Page 2 <br />
