<br />3. EXCLUSIONS: This Agreement shall not cover Unacceptable Waste, and <br />Contractor will not be responsible, for hauling Unacceptable Waste, animal waste, auto <br />parts, rocks, concrete, sand, gravel, dirt, or Construction Debris, unless specifically <br />contracted for with the generator of such refuse. <br /> <br />4. TERM: The term of this Agreement shall commence August I, 2005 <br />("Commencement Date") and continue to remain in full force and effect through July 31, <br />2015. Unless either City or Contractor elect not to renew and extend the Agreement, and <br />gives notice by certified mail (return receipt requested) to the other party in writing not <br />less than 180 days prior to the expiration of this Agreement, this Agreement will <br />automatically renew for one successive five (5) year term~ subject to all the terms and <br />conditions set forth in this Agreement. <br /> <br />5. <br /> <br />RATES: <br /> <br />5.01 Residential Rates: Contractor shall receive from City $8.50 per month, <br />per Residential Unit served, for the services to be furnished under this Agreement <br />("Rates"). <br /> <br />5.02 Abandoned Home Demolition DisDosai Rates: During the term of <br />this Agreement, Contractor agrees to accept for disposal at its Landfill, at no cost <br />to City, either (I) up to one hundred fifty (150) tons per Agreement year (the <br />"Tonnage Method") of Residential Waste collected by the City from the <br />demolition of abandoned Residential Units (the "Abandoned Hom~ Demolition <br />Waste"), or (ii) up to twenty-five (25) pulls of a thirty (30) cubic yard roll off <br />container per Agreement year containing Abandoned Home Demolition Waste <br />(the "Roll Off Method"). In the event the City shall request Contractor to accept <br />for disposal at its Landfill Abandoned Home Demolition Waste in excess of (I) <br />one hundred fifty (150) tons per Agreement year, or (ii) twenty-five (25) pulls of <br />a thirty (30) cubic yard container per Agreement year, as the case may be (the <br />Excess Abandoned Home Demolition Waste"), then the Excess Abandoned <br />Home Demolition Waste shall be disposed of at the Landfill for the then current <br />posted gate rate, less twenty percent (20%). If the City selects the "Roll Off <br />Method" and the quantity of pulls exceeds twenty-five (25) pulls in a calendar <br />year, the excess pulls shall be charged to the City at the prevailing haul rate plus <br />Disposal at the discount described above. The prevailing haul rate for the rust <br />year of this Agreement will be $187.00 (One Hundred and Eighty Seven Dollars). <br />Prior to the commencement of any Agreement year, the City shall select disposal <br />of the Abandoned Home Demolition Waste utilizing either the Tonnage Method <br />or the Roll Off Method, and the City shall not be entitled to utilize both such <br />methods during anyone (1) Agreement year. <br /> <br />5.03 Collection from City Facilities Without Charge: Throughout the term of <br />this Agreement, including any extension thereof, Contractor shall provide Solid <br />Waste collection, handling, and disposal services (excluding Unacceptable Waste, <br />and all roll off container service, including sludge materials) free of charge at <br /> <br />SOLID WASTE AGREEMENT <br /> <br />Page 6 <br />
