<br />DRAFT <br /> <br />F:A TTORNEY\ORDWORK.\CURREN1\ GIS Info System for Library Ord <br />July 6, 2005 <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, <br />PARIS, TEXAS, APPROVING AND AUTHORIZING A CONTRACT BY <br />AND BETWEEN THE CITY OF PARIS AND GIS INFORMA TION <br />SYSTEMS, INC., FOR THE PURCHASE OF THE GAYLORD POLARIS <br />INTEGRATED LIBRARY SYSTEM, A COMPREHENSIVE <br />REPLACEMENT INFORMATION COMPATIBLE INTEGRATED <br />COMPUTER SYSTEM FOR USE BY THE CITY OF PARIS PUBLIC <br />LIBRARY; MAKING PROVISION FOR USE OF LIBRARY TRUST FUNDS <br />IN THE PURCHASE OF SAID SYSTEM; MAKING OTHER FINDINGS AND <br />PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the current integrated library computer system of the City of Paris Public <br />Library is Gaylord Information Systems (GIS Galaxy), which has been in use at the library for over <br />10 years; and, <br /> <br />WHEREAS, the aforesaid computer system is used for all substantive computer related <br />functions of the library, including bibliographic records, item records, patron records, transactions, <br />and other similar functions; and, <br /> <br />WHEREAS, the current system, which is itself a proprietary system exclusively owned by <br />GIS Information Systems, Inc. is reaching the end of its useful life and its capability to accommodate <br />the expanded needs of the City of Paris Library; and, <br /> <br />WHEREAS, Gaylord Information Systems, Inc. has presented a proposal to the City Library <br />for providing the Gaylord Polaris Integrated Library System, an upgraded version of the Library's <br />current system which is more user friendly, will offer an expansion of services, and can integrate <br />seamlessly with the City's current system without loss of data and at a cheaper price; and, <br /> <br />WHEREAS, the aforesaid proposed new system is likewise a proprietary system protected <br />by patents, copyrights, or other proprietary arrangements; and, <br /> <br />WHEREAS, Chapter 252, Section 252.022 (a) 7 (A) of the Texas Local Government Code <br />exempts from the requirements of competitive bidding, items available from only one source because <br />of patents, copyrights, secret process, or natural monopoly, and thereby authorizes governmental <br />entities and municipalities to purchase such items without the necessity for competitive bidding; and, <br /> <br />WHEREAS, by prior action of the City Council, the City of Paris is governed by Chapter <br />252 of the Local Government Code; and, <br /> <br />I <br />
