<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE NO. 96-009 <br /> <br /> AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE <br /> CODE OF ORDINANCES, CITY OF PARIS, BE AMENDED BY REVISING CHAPTER <br /> 12, ARTICLE IV, SECTIONS 12-86, 12-87 AND 12-89 OF SAID CODE; PROVIDING <br /> FOR ADOPTION OF THE STANDARD FIRE PREVENTION CODE, 1994 EDITION; <br /> PROVIDING FOR DELETIONS, MODIFICATIONS AND AMENDMENTS TO SUCH <br /> CODE; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL <br /> ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND <br /> PROVIDING FOR AN EFFECTIVE DATE OF MARCH 1, 1996. <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br /> <br /> Section 1. That Chapter 12, Article IV, Sections 12-86, 12-87 and 12-89 of the Code <br /> of Ordinances of the City of Paris, Paris, Texas, be, and the same are hereby, amended so that <br /> such shall read as follows: <br /> <br /> "Sec. 12-86. Standard Fire Prevention Code - Adoption. <br /> <br /> "For the purpose of establishing rules and regulations for fire prevention <br /> relating to public safety, health and general welfare within the City and its <br /> extraterritorial jurisdiction, where applicable, that certain fire prevention code <br /> known as the Standard Fire Prevention Code, 1994 Edition, save and except such <br /> portions as are deleted, modified or amended by this article, is hereby adopted <br /> and incorporated as fully as if set out at length herein. A copy of such Code has <br /> been and is now on file in the office of the City Clerk, and the provisions thereof <br /> shall be controlling as above stated. <br /> "Section 12-87. Standard Fire Prevention Code - Amendments. <br /> <br /> "The Code adopted by Section 12-86 is hereby amended as set out in this <br /> section: <br /> <br /> "Section 105, Board of Adjustment & Appeals, is revised to read as follows: <br /> <br /> "`The board of appeals established in Section 7-20 of the Code <br /> of Ordinances is hereby designated to serve as the board of appeals <br /> and adjustments with regard to matters pertaining to the Standard <br /> Fire Prevention Code, with powers to recommend variances to the <br /> application of any provision of such Code and to pass on related <br /> matters. The Fire Official, or his authorized representative, shall <br /> be an ex-officio member of such board when acting with regard to <br /> the Fire Prevention Code and shall serve as secretary to such <br /> board in such matters.' <br /> <br /> "Section 107, Compliance and Penalty, is added to read as follows: <br /> <br /> "`Any person operating or maintaining any occupancy, premises <br /> or vehicle subject to this Code who shall permit any fire hazard to <br /> exist on premises under his control, or who shall fail to take <br /> immediate action to abate a fire hazard when ordered or notified <br /> to do so by the Fire Official, or his duly authorized representative, <br /> shall be guilty of a misdemeanor and, upon conviction, shall be <br /> fined in any sum not to exceed two thousand dollars ($2,000.00), <br /> and each and every day's continuance of any violation of the <br /> provisions hereof shall constitute and be deemed a separate <br /> offense.' <br />
