<br /> <br /> <br /> <br /> <br /> <br /> ORDINANCE NO. 96-015 <br /> <br /> <br /> AN ORDINANCE OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING FOR THE <br /> ESTABLI5HMENT OF MAXIMUM, REASONABLE AND PRUDENT RATES OF SPEED <br /> ON CERTAIN PORTIONS OF CERTAIN STREETS AND HIGHWAYS AND PUBLIC <br /> PLACES IN THE CITY OF PARIS; PROVIDING FOR A PENALTY NOT TO EXCEED <br /> $200.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN <br /> CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE OF APRIL <br /> 1, 1996. <br /> WHEREAS, the Transportation Operations Office of the Texas Department of <br /> <br /> Transportation prepared an engineering and traffic study and survey to determine the maximum, <br /> reasonable and prudent speeds for vehicles traveling upon certain portion of certain streets and <br /> highways, and parts thereof, the most effective use of said streets and highways, and the safest <br /> and most effective movement of vehicular traffic thereon; and, <br /> <br /> WHEREAS, such study and survey recommends certain maximum, reasonable and <br /> prudent rates of speed for vehicular traffic upon said streets and highways, and parts thereof, <br /> located within the City of Paris, and it is deemed appropriate that the City Council of the City <br /> of Paris establish the same based on such recommendation; NOW, THEREFORE, <br /> <br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS: <br /> <br /> Section 1. That the following maximum, reasonable and prudent rates of speed for <br /> vehicular traffic upon certain streets and highways located within the City of Paris, as <br /> determined by an engineering and traffic study and survey prepared by the Transportation <br /> Operations Office of the Texas Department of Transportation, be, and the same are hereby, <br /> established as hereinafter set out for the streets and highways and portions thereof to which they <br /> apply: <br /> (a) No person shall drive a vehicle upon a public road, street or highway <br /> located in the City of Paris at a speed greater than is reasonable and prudent <br /> under the conditions and circumstances then existing. Except when a special <br /> hazard exists that requires lower speeds for compliance with the above <br /> requirement, the limits hereinafter set out shall be lawful, but any speed in excess <br /> of the limits as hereinafter set out for the streets and highways, and portions <br /> thereof, to which they apply shall be prima facie evidence that the speed is not <br /> reasonable or prudent: <br /> <br /> (1) On F.M. Highway 905, southeasterly from the <br /> centerline of Loop 286 to the City Limits of Paris, a distance of <br /> approximately 0.780 miles, a speed limit of forty-five (45) miles <br /> per hour at all times, as evidenced by the plan attached hereto as <br /> Exhibit A; <br /> <br /> (2) On F.M. Highway 79, southerly from the north City <br /> Limits of Paris, a distance of approximately 1.008 miles, a speed <br /> limit of forty-five (45) miles per hour at all times; thence southerly <br /> a distance of approximately 0.626 miles, a speed limit of forty (40) <br /> miles per hour at all times; thence southerly to the centerline of <br /> BU 82 H(Bonham Street), a distance of approximately 0.613 <br /> miles, a speed limit of thirty-five (35) miles per hour at all times, <br /> except that a school speed limit of twenty (20) miles per hour will <br /> be effective on school days, from approximately highway milepoint <br /> 22.014 to approximately milepoint 22.304 only during the <br /> following hours: from 45 minutes before school opens until <br /> classes begin; from the beginning to the end of the lunch period, <br /> if needed, and for a 30 minute period beginning at the close of <br /> school, as evidenced by the plan attached hereto as Elchibit B; <br />
