<br /> AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY
<br /> OF PARIS, PARIS, TEXAS, AND CHANGING THE BOUNDARIES ESTABLISHED BY
<br /> THE ZONING MAP OF SAID CITY; ESTABLISHING A COMMERCIAL DISTRICT (C)
<br /> WITH SPECIFIC USE PERMIT (49) AUTO FUEL SALES ON LOT 11, CITY BLOCK
<br /> 315, ON PROPERTY BELONGING TO SAMMY BOLTON, SO AS TO INCLUDE
<br /> THEREIN TERRITORY FORMERLY DESIGNATED A5 A COMMERCIAL DISTRICT
<br /> (C); DESIGNATING THE BOUNDARIE5 OF THE COMMERCIAL DISTRICT (C) WITH
<br /> SPECIFIC USE PERMIT (49) AUTO FUEL SALES SO ESTABLI5HED; PROVIDING
<br /> FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR
<br /> PARTS OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR AN
<br /> EFFECTIVE DATE OF JANUARY 1, 1996.

<br /> BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS:
<br />
<br /> Section 1. That the boundaries heretofore established by the Zoning Map and Ordinance
<br /> No. 1710 of the City of Paris, Paris, Texas, be, and the same are hereby, changed, and that a
<br /> COMMERCIAL DISTRICT (C) WITH SPECIFIC USE PERMIT (49) AUTO FUEL SALES
<br /> be, and the same is hereby, established on LOT ll, CITY BLOCK 315, on property belonging
<br /> to SAMMY BOLTON, so as to include in such COMMERCIAL DISTRICT (C) WITH
<br /> SPECIFIC USE PERMIT (49) AUTO FUEL SALES the hereinafter described property, which
<br /> was formerly and is presently designated as a COMMERCIAL DISTRICT (C), and that the
<br /> boundaries of said COMMERCIAL DISTRICT (C) WITH SPECIFIC USE PERMIT (49) AUTO
<br /> FUEL SALES, be, and the same are hereby, established as follows:

<br /> SITUATED within the corporate limits of the City of Paris, County of
<br /> Lamar, and State of Texas, and being all that certain tract or parcel of land
<br /> situated in the Enoch Crow Survey, No. A-208, located 3 miles East from the
<br /> Public Square in the City of Paris, Lamar County, Texas, being all that certain
<br /> Lot 11 of Block 315 as reflected on the Tax Maps of the City of Paris and being
<br /> the same property described in deed to Hoyd Branch et al., dated March 8, 1995,
<br /> of record in Book 511, Page 167, Lamar County Real Property Records, also
<br /> being part of that certain 9 acre tract described in a Deed from Clyde Louise
<br /> Arnold to Gene Arnold, et al, dated August 17, 1989, recorded in Vol. 105, Page
<br /> 194, Real Property Records of Lamar County, Texas and being more particularly
<br /> described as follows;
<br /> BEGINNING at a found 1/2" capped iron pin for corner, being on the
<br /> southwest corner of said 9 acre tract, being on the North boundary line of Lamar
<br /> Ave. which is also U.S. Hwy 82, and being on the Southeast corner of a 0.3182
<br /> acre tract described in a Deed to Wal-Mart Stores, dated March 20, 1994,
<br /> recorded in Vol. 431, Page 1, Real Property Records of Lamar County, Texas;
<br /> THENCE N 0° 01' E along the fenced West boundary line of said 9 acre
<br /> tract and the East boundary line of said 0.3182 acre tract a distance of 149.93
<br /> feet to a found 1/2" capped iron pin for an angle point, being on the Northeast
<br /> corner of said 0.3182 acre tract and being on the Southeast corner of a 3.0335
<br /> acre tract described in a deed to Wal-Mart Stores, dated March 21, 1994,
<br /> recorded in Vol. 431, Page 11, Real Property Records of Lamar County, Texas;
<br /> THENCE N 0° 02' 40" E along the fenced West boundary line of said 9
<br /> acre tract and the East boundary line of said 3.0335 acre tract a distance of 59.97
<br /> feet to a found 1/2" capped iron pin far a corner, being on the Southwest corner
<br /> of a 9.0036 acre tract described in a deed to Wal-Mart Stores, dated March 21,
<br /> 1994, recorded in Vol. 431, Page 14, Real Property Records of Lamar County,
<br /> Texas;
<br /> THENCE East along the South boundary line of said 9.0036 acre tract a
<br /> distance of 209.86 feet to a found 1/2" capped iron pin for a corner, being on the
<br /> Southeast corner of said 9.0036 acre tract and being on the West boundary line
<br /> of a 6 acre tract described in a deed to David C. Miesch, et ux, Jo Peevey
